Four Charged in International Uganda-Based Cyber Counterfeiting Scheme

A federal grand jury in Pittsburgh, Pennsylvania, has indicted four people in connection with an international counterfeit currency operation headquartered in the African nation of Uganda, announced U.S. Attorney David J. Hickton for the Western District of Pennsylvania.

The indictment, returned on April 1, 2015, charges Ryan Andrew Gustafson, 27, aka “Jack Farrel” aka “Willy Clock,” a U.S. citizen currently incarcerated in Kampala, Uganda, Zackary L. Ruiz, 18, aka “Mr. Mouse,” of Las Vegas, Nevada, Jeremy J. Miller, 30, aka “Sinner,” of Seattle, Washington and Michael Q. Lin, 20, aka “Mlin” aka “Mr. Casino,” of Bethlehem, Pennsylvania, with conspiracy and counterfeiting acts committed within and outside of the U.S. from December 2013 until December 2014.

“Today we announce the dismantling of an international cyber conspiracy in which Ugandan-made counterfeit Federal Reserve Notes were being advertised, bought and sold through online criminal forums then passed in coffee shops and corner stores in neighborhoods across our country,” said U.S. Attorney Hickton.  “Working cooperatively with law enforcement partners in the U.S. and abroad, we were able to quickly infiltrate and disrupt this counterfeit trafficking network and limit losses.”

“The early and aggressive application of traditional and cyber investigative expertise and the cooperation and assistance of numerous domestic and international law enforcement agencies in this case led to the quick and efficient identification of conspirators in a widespread cyber-based counterfeiting network,” said Special Agent in Charge Eric P. Zahren of the U.S. Secret Service Pittsburgh Field Office, “but as importantly, minimized financial losses in the U.S. and elsewhere, consistent with our charge to protect our currency, our commerce and, ultimately, our communities.”

According to the indictment, in late December 2013, Gustafson created his own dark web website called Community-X, which was dedicated to the manufacturing, selling, buying, distribution and passing of counterfeit Federal Reserve Notes (FRNs), which he claimed to have manufactured.  The website contained forums where members discussed the counterfeit bills and shared tips on how best to pass, ship and distribute counterfeit FRNs.

In September 2014, Gustafson redesigned this website into two different sites, a Community-X HQ site, with controlled access and a Community-X Recruitment Center site, which was accessible to the public.  Gustafson, Ruiz and Miller were active members of both sites.  Lin was only a member of the Recruitment Site.

Gustafson and others allegedly sold these counterfeit FRNs to purchasers in the U.S.  From December 2013 through February 2014, an associate of Gustafson sent DHL packages containing these counterfeit FRNs to individuals in the U.S.  After February 2014, Gustafson had the counterfeit FRNs smuggled into the U.S. by hiding the counterfeit FRNs in glued together pages of fake charity pamphlets.

The indictment alleges that Ruiz, Miller and Lin had varied levels of roles and responsibilities as participants in the conspiracy.  In particular, the indictment alleges that Ruiz and others unpacked the counterfeit FRNs, that Ruiz, Miller and others treated the counterfeit FRNs to prepare them for passing and used the U.S. Postal Service to mail the treated FRNs to re-shippers and to purchasers and that Lin was a purchaser of the FRNs, who offered a guide on how to pass the counterfeit notes through casinos.

The indictment alleges more than $1.4 million in counterfeit FRNs have been seized and passed worldwide, both overseas and in the U.S. as part of this scheme.

Gustafson was charged by Ugandan authorities on Dec. 16, 2014, with conspiracy, possession of counterfeit, selling/dealing in counterfeit and unlawful possession of ammunition. He is presently on trial in Uganda on their charges.

The law provides for a maximum total sentence of five years in prison, a fine of $250,000, or both, on the conspiracy count; a maximum total sentence of 20 years in prison, a fine of $250,000, or both, on the conspiracy to commit money laundering count; and a maximum total sentence of 20 years in prison, a fine of 250,000, or both, on each of the passing and receiving counterfeit money counts.  Under the Federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offense and the prior criminal history, if any, of the defendant.

REP. POWER'S REMARKS ON DOMINIC ONGWEN'S ARRIVAL AT INTERNATIONAL CRIMINAL COURT

Dominic Ongwen’s arrival at the International Criminal Court in the Hague is a welcome development in the international community’s campaign to counter the LRA’s dehumanizing violence, and to bring perpetrators to justice after more than two decades of the LRA’s brutal campaign of torture, rape and murder.

I commend the governments of the Central African Republic and Uganda, as well as the leadership of the African Union, for their close coordination on this effort and for their commitment to ensuring that perpetrators of human rights violations face justice.

The fact that Ongwen will finally face trial is the latest sign of tangible progress in the African Union-led effort to end the threat posed by the LRA and its leader, Joseph Kony, to which the United States has dedicated considerable resources, including more than 100 U.S. military advisors. Today’s outcome is a great example of what can result from regional coordination in combating the LRA, and it is imperative that the African Union Regional Task Force (AU-RTF) continue to coordinate with regional governments, the United Nations Organization Stabilization Mission in the Democratic Republic of the Congo (MONUSCO), the United Nations Multidimensional Integrated Stabilization Mission in the Central African Republic (MINUSCA), and the United Nations Regional Office for Central Africa (UNOCA) in its fight against the LRA, which still remains a serious threat to regional peace and security.

Those remaining LRA members should follow the lead of Dominic Ongwen and the more than 250 other individuals who have left the LRA since 2012. They should end their lives on the run and turn themselves in.

The United States continues to look forward to the end of the LRA and the day when its victims will finally be free from LRA terror, seeing justice that is long overdue.

DOJ ANNOUNCES CHARGES FILED RELATED TO INTERNATIONAL CYBER COUNTERFEITING SCHEME BASED IN UGANDA

Criminal Charges Filed Against U.S. Citizen in Connection with a Multi-Million Dollar International Cyber Counterfeiting Scheme Based in Uganda

U.S. Attorney David J. Hickton for the Western District of Pennsylvania and U.S. Secret Service Special Agent in Charge Eric P. Zahren of the Pittsburgh Field Office today announced the filing of a criminal complaint in Pittsburgh charging a U.S. citizen with leading an international counterfeit currency operation headquartered in the Republic of Uganda.

Ryan Andrew Gustafson, aka Jack Farrel, aka Willy Clock, 27, a U.S. citizen currently residing in Kampala, Uganda, was charged with conspiracy and counterfeiting acts committed outside of the U.S.  When he lived in the United States, he mainly resided in Texas and Colorado.

“This complicated, international cyber counterfeiting conspiracy was broken as a result of expert investigation by the Secret Service and a total commitment of all cooperating law enforcement to reject the premise that criminals committing cybercrimes in the U.S. – but who reside outside our borders – cannot be reached,” stated U.S. Attorney Hickton.  “We will hold cyber criminals accountable and bring them to justice no matter where they reside.”

“This investigation involves the manufacture of counterfeit U.S. currency, which has been the Secret Service’s core mission since 1865,” said Special Agent in Charge Zahren.  “Add to that the modern elements of an international counterfeiting conspiracy utilizing new-age, cyber technology, and it represents the full evolution and unique investigative capabilities of today’s Secret Service.”

As detailed in the affidavit in support of the criminal complaint, in December 2013, the Secret Service began investigating the passing of counterfeit Federal Reserve Notes (FRNs), believed to be manufactured in Uganda, at Pittsburgh-area retail stores and businesses.  Agents determined that an individual identified as J.G. had passed these notes and was renting a postal box at The UPS Store on Pittsburgh’s South Side.  On Feb 19, 2014, law enforcement learned that J.G. received three packages addressed from Beyond Computers, located in Kampala, Uganda.  Agents executing a search warrant on the packages found $7,000 in counterfeit $100, $50 and $20 FRNs located in two hidden compartments within the packaging envelopes.  A fingerprint on a document inside one of the packages was identified as belonging to Ryan Andrew Gustafson.

The Secret Service subsequently worked with Ugandan authorities to identify the source of the counterfeit FRNs.  Their efforts led to A.B., who admitted to sending the packages, explaining that an American named “Jack Farrel,” and another person, provided him the counterfeit notes to ship.  Based on information provided by A.B., the Secret Service used facial recognition to identify Jack Farrel as Ryan Andrew Gustafson.

According to the affidavit, J.G. met “Willy Clock” on an online criminal forum called Tor Carding Forum.  Through private messaging, J.G. and Clock discussed counterfeit currency and J.G. agreed to purchase counterfeit FRNs.

In January 2014, Clock told J.G. that he had established his own online forum called Community-X, a website dedicated to the selling of counterfeit reserve notes.  The forum requires a username and password to access the site, and individuals must be invited and approved by Clock to become members. Secret Service used an undercover operative to communicate with Clock through the website, to purchase additional counterfeit $100 FRNs, and to become a re-shipper of counterfeit notes.

In November 2014, the Secret Service executed a search warrant at the residence of another re-shipper, who had been an active member of Community-X.  This person cooperated and provided information that a forum member had traveled to Uganda and brought back more than $300,000 in counterfeit notes.

The Secret Service, working with Ugandan authorities, engaged yet another confidential informant, in Uganda, who had knowledge of Jack Farrel and his counterfeiting operations.  On Dec. 11 2014, this confidential informant called Farrel to arrange to purchase counterfeit FRNs.  The informant met Farrel’s associate and made the buy.  Two trusted sources followed the associate back to Farrel’s home and reported the location to the Secret Service who turned it over to the Uganda Special Investigations Unit.  Their search of Farrel’s residence netted two million Ugandan shillings from the buy; $180,420 in counterfeit FRNs; counterfeit Euros, Indian Rupees, Ugandan Shillings, Congo Francs, and Ghana Cedis; computers and printers; inks and ink jet cartridges; paper cutters; glue sticks; “Give a Child Hope Today” pamphlets with counterfeit FRNs in between glued together pages; and a pair of “Anon Hands.”  Anon Hands are life-like rubber molds that fit like gloves over the user’s hands and are meant to conceal the wearer’s fingerprints.  As noted above Farrel has been identified as Gustafson.  Evidence collected at the scene also allowed investigators to identify Gustafson as Willy Clock.

Gustafson was charged by Ugandan authorities on Dec. 16 with conspiracy, possession of counterfeit, selling/dealing in counterfeit, and unlawful possession of ammunition.  He was brought before the court that day to be informed about the charges; he also is being represented by counsel in Uganda.

U.S. Secret Service estimates $1.8 million in counterfeit FRNs have been seized and passed in Uganda.  The total amount of Ugandan-made counterfeit FRNs seized or passed domestically was approximately $270,000.  This amount was limited due to early detection by the Secret Service.

U.S. law provides for a maximum total sentence of 25 years in prison, a fine of $500,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offense and the prior criminal history, if any, of the defendant.

U.S. Attorney Hickton commended numerous agencies and organizations for conducting the investigation leading to charges in this case, including the Directorate of Public Prosecution, the Criminal Investigations and Intelligence Department, the Special Investigations and Intelligence Unit, and Stanbic Bank in Uganda; various domestic and foreign Secret Service Field Offices, including the Rome, Italy, Field Office and the Criminal Investigative Division in Washington, D.C.; the U.S. State Department; the U.S. Postal Inspection Service; the Federal Bureau of Investigation; Homeland Security Investigations; U.S. Customs and Border Protection and the National Cyber-Forensics & Training Alliance.

Assistant U.S. Attorney Shardul S. Desai is prosecuting this case on behalf of the government.

A criminal complaint contains charges and is not evidence of guilt.  A defendant is presumed to be innocent until and unless proven guilty.

SECRETARY KERRY: It’s my pleasure to welcome President Kiir of South Sudan. The president and I have visited many times there and here, and I’ve had the privilege of being with him at the moment that the referendum took place that gave birth to the nation of South Sudan. This is a very timely meeting because right now South Sudan is suffering the fate of being the most food-insecure nation in the world as a consequence of manmade circumstances. There is a struggle going on, which has been going on for some time, in which innocent civilians are caught up. And President Kiir has agreed – along with the former Vice President Riek Machar – to negotiate, and ultimately to engage in the creation of a unity transition government.
That transition government needs to be negotiated, and the neighbor countries – Kenya, Uganda, Ethiopia – have been deeply involved together even with Sudan in trying to help bring parties together and see if we can’t resolve this in a peaceful way. So our hope is that we can have a discussion today that helps to clarify the road ahead, to try to minimize the violence. There is a commission of inquiry on what has been happening on the ground. It’s very important for us to figure out how that will also figure into the future here.

The most important thing, and I know President Kiir agrees with this, is to make sure that the people are able to find security, and hopefully that we’re able to get food, medicine, humanitarian assistance to people at a time of huge need. And I look forward to my conversation with the president this morning.

Mr. President, if you want to say anything.

PRESIDENT KIIR: Well, thank you very much, Honorable Secretary, and it’s my pleasure to be in Washington at this moment, and on bilateral issues and for your also involvement in the issues of our country. The situation in South Sudan today, of course, on the ground it is not as been reported in the media. And if the two sides – that is the government and the rebels – were forthcoming, all of them, this thing could have been resolved a long time back. But we get difficulty on the side of the rebels. We signed the cessation of hostilities with the leader of the rebels in May on the 9th, which he did not respect. We again met in June and we signed another recommitment, cessation of hostilities on the 10th of June, but they did not abide with all these agreements.

I always say that Riek Machar is not in control of what he calls his army. And so each commanders in different areas are operating on their own. I want to repeat what I said in that meeting, the last meeting. I told the press that if peace was to be brought to South Sudan today or tomorrow, I will be happy because the people who are dying on both sides are my people. I am an elected president, and the people who elected me were not from my tribe. I was elected by all the people of South Sudan. So other people die in support of Riek Machar or is my support – these are all my people.

Those who are in need of humanitarian assistance can be served anywhere, wherever they are. This is still my position today, that if there is any humanitarian assistance, that ought to be delivered to the people who are affected. This thing has – can go unhindered. And it has been happening that humanitarian assistance has been going to the areas affected by this conflict. I’m hopeful that we are going to find a solution very soon to that conflict. Thank you.

SECRETARY KERRY: Thank you, Mr. President. I just want the record to be clear that it is our judgment – and the former Vice President Mr. Machar needs to understand this – that he has broken – it was his initiative that broke the agreement and took his troops back into a violent status. And he needs to understand the importance of living by the agreements. In my conversations with the prime minister of Ethiopia, who made it clear this is his judgment also, he needs to understand the international community is going to be impatient with those breaches.

So what we’re looking for is the fulfillment of the agreement, which means moving to a transition government that heals the wounds and brings people together. And we have said before and I reiterate now that the president is the duly elected, constitutional president of South Sudan, and this is a rebel group. Nevertheless, it needs to understand the importance of adhering to international agreements and the importance of bringing this to a negotiated conclusion and path forward.

So I hope today we can find a way to get back to these talks in a serious way, Mr. President, and I thank you very, very much for your statement and for being here to join us for this conversation. Thank you all very much.

SECRETARY KERRY MAKES REMARKS WITH IGAD LEADERS

SECRETARY KERRY: Thank you very much. It’s my pleasure to be here with the IGAD leaders: the presidents of Kenya, of Uganda, and Djibouti; and the prime minister of Ethiopia, who is the chair of this effort. And we just met with respect to the situation in South Sudan, and there is a unanimous agreement that this war must end and must end now. These leaders will go back to their region and meet in Addis Ababa very, very soon, where they will decide on specific actions that they are prepared to take in unanimous fashion with their countries in an effort to guarantee that the war comes to an end. They are prepared to issue a final ultimatum to the parties to come to the table, and in addition to that, the United Nations Security Council will be visiting – the entire Security Council – next week to make it clear there is no other alternative except to proceed with the plan of these leaders that they have put on the table.
The United States is fully supportive of that effort, and we will do everything in our power to make a difference. There’s a threat of starvation for 50,000 children, there’s a continued threat to life, there is a tribal series of attacks on both sides taking place that is simply unacceptable. And I wanted to thank the leaders for their leadership. We applaud their initiative to find an African solution and to take the leadership, and we’re particularly encouraged by that.
I was just asked if it’s all right with everybody if the prime minister wants to say a few things as the chair.

PRIME MINISTER DESALEGN: Secretary Kerry, thank you very much for letting me speaking with IGAD leaders. We in the IGAD region and leaders have agreed that the war has to stop and stop very, very quickly. And the region has come a long way in sorting out the problem, and to solve this problem we will stand together. And in this regard, we have come to the end now. The violation of the ceasefire has taken place by Riek Machar.

And so the region has put the comprehensive solution to the government of transitional national unity, which is going to be established in South Sudan. And both parties has to agree to this proposal of the region. And I think if the parties do not agree on the proposal that the region has put in place after studying (inaudible) circumstances in South Sudan, then the region is going to take strong action, as we have put in the IGAD summit – punitive action that has to be taken immediately after convening the meeting of IGAD heads of state and government in Addis Ababa very soon after this summit.

So the region has come to the climax and the human catastrophe has to stop. In this regard, we are ready to propose our proposal, and if they agree, then your ambassador will come to South Sudan. If not, then the region is going to take strong action.

SECRETARY KERRY: Thank you, folks. We just had a very positive meeting, laid out a strong agenda which we all agreed on which we’ll talk about later in the day when we have a little more time. But I think it’s clear that everybody is in agreement the killing must stop; that humanitarian access needs to be delivered; most importantly, a legitimate force that has an ability to help make peace needs to get on the ground as rapidly as possible. And we agreed on both the terms and timing and manner and size, and we need to go to work to make sure that happens. I think that’s a quick summary.

FOREIGN MINISTER TEDROS: Thank you.

SECRETARY KERRY: Anybody else?

FOREIGN MINISTER TEDROS: Thank you. I think I agree with him. One thing that we have stressed is the deployment – as Secretary Kerry said, the deployment of the force as soon as possible. And I think with that, many of the other interests can be addressed. And I would like to use this opportunity, actually, on behalf of my colleagues and myself to thank Secretary Kerry, who is here today with us. But since the crisis started, he has been in contact regularly, frequent phone calls and good support, and we hope that support will continue, especially from him and the U.S. Government, and we really appreciate the support.

U.S. STATEMENT ON NEW LGBT LAW

Statement by the Press Secretary on Uganda

Instead of standing on the side of freedom, justice, and equal rights for its people, today, regrettably, Ugandan President Museveni took Uganda a step backward by signing into law legislation criminalizing homosexuality.  As President Obama has said, this law is more than an affront and a danger to the gay community in Uganda, it reflects poorly on the country's commitment to protecting the human rights of its people and will undermine public health, including efforts to fight HIV/AIDS.  We will continue to urge the Ugandan government to repeal this abhorrent law and to advocate for the protection of the universal human rights of LGBT persons in Uganda and around the world.

SECRETARY CLINTON: Good afternoon, everyone. It is such a personal pleasure for me to welcome the Chairperson here for our high-level meetings. This is our third high-level meeting, and we highly value the relationship and the increasing cooperation that we are enjoying with the African Union. And of course, I want to congratulate the Chairperson for becoming the first woman chair of the African Union.

I want to start by saying a few words about the ongoing situation in the Democratic Republic of Congo. The humanitarian impact of this conflict in the eastern part of the country is devastating. More than 285,000 people have been forced to flee their homes since this rebellion began back in April. They are in critical need of assistance. Health workers in Goma have been killed and abducted. Members of civil society, human rights activists, judicial authorities throughout the Democratic Republic of Congo have received death threats. The United States strongly condemns these tactics of fear and intimidation. And those who abuse human rights must be held accountable.

Assistant Secretary Johnnie Carson has been in the region holding discussions with leadership from the DRC, Rwanda, and Uganda to try to help bring about a ceasefire. We strongly support continued cooperation among the leaders of these countries and throughout the region and commend the African Union for its recent decision to send a special envoy to the Great Lakes.

With regard to the M23 rebel group, there is only one way forward: They must meet their commitments under the Kampala Accords to cease their attacks, withdraw from Goma, and pull back to the July lines. Under the Kampala Accords, President Kabila’s government has agreed to hear and address the grievances of the M23 leaders, and we call on leaders and governments from throughout the region to halt and prevent any support to the M23 from their territory.

Now this is just one issue that illustrates the importance of enhanced, strong cooperation between the African Union and the United States. First, on peace and security, we strongly support the AU missions in Somalia and Darfur as well as the AU’s facilitation efforts in Sudan and South Sudan. And we are working to support the AU’s leadership with respect to the crises in Mali, and as I said, eastern DRC.

The AU is the partner who is best able to empower and mobilize the resources and the will throughout the continent to address crises, and we are very pleased to see this strong role getting even stronger. Secondly, we want to work together to promote credible elections and foster good governance, strong transparent institutions, and democracy. Third, we want to enhance trade and investment between the United States and Africa. As I never tire of saying, seven of the world’s ten fastest-growing economies are located in Africa. And we want to do more to really see greater prosperity across the continent.

We have a lot of work ahead of us. This high-level meeting builds on President Obama’s presidential policy directive on Sub-Saharan Africa, and we are going to do all that we can to promote peace and prosperity. So it’s a great pleasure to have this meeting, which is a two-day set of meetings here in the State Department and in agencies across our government, and to work together on a framework for implementation with timelines and accountability, something that both the Chairperson and I believe strongly in doing, so that everyone knows what we are trying to achieve together.

So, thank you so much.

CHAIRPERSON DLAMINI-ZUMA: Well, thank you very much. We are very happy to be here, and our approach to this meeting is that we have to have a balance between dealing with crises and peace and security matters with development, because we feel that these are two sides of the same coin. If we delay development, there’ll be more crises and more instability. But at the same time, if we don’t deal with the security situation, we can’t develop. So that balance for us is very important. And going forward, we are working as the AU towards a prosperous Africa which is at peace with itself and the world. And so all our efforts are geared towards those – towards that vision. And we have had very fruitful discussions. And obviously, discussions are as good as the follow-up, and we are going to make sure that we follow up on all the decisions that – and discussions that we’ve had. Thank you.

MS. NULAND: Good. We’ll take two this evening. We’ll start with CNN, Jill Doughterty.

QUESTION: Madam Secretary, thank you. I wanted to ask you about tomorrow. The Palestinians go to the United Nations, asking for non-observer status. We know that the U.S. objects, and we know many of the reasons. But why are you adamant about it at this point when Mahmoud Abbas could use some shoring up at home – he’s losing support – and even as Hamas is gaining support?

And then if I could ask you one question on Benghazi: Some are saying since the State Department is responsible for embassies, why wasn’t it you who was on the talk shows on Sunday, as opposed to Ambassador Rice?

Thank you.

SECRETARY CLINTON: Well, first with regard to the Palestinian question, I have said many times that the path to a two-state solution that fulfills the aspirations of the Palestinian people is through Jerusalem and Ramallah, not New York. We have made very clear to the Palestinian leadership – you know I met with President Abbas just last week – that we oppose Palestinian efforts to upgrade their status at the UN outside of the framework of negotiations to achieve a two-state solution, because no matter what happens at the United Nations, it will not produce the outcome that this government, this President, and certainly I strongly support. And the only way to get a lasting solution is to commence direct negotiations, and we need an environment conducive to that. And we’ve urged both parties to refrain from actions that might in any way make a return to meaningful negotiations that focus on getting to a resolution more difficult. So I may have more to say about that later, but certainly that’s our overall view.

Let me just say, first of all, that Susan Rice has done a great job as our Ambassador to the United Nations. And of course, this decision about my successor is up to the President, but I’m very happy he has the opportunity with a second term to make a decision. And I’m not going to answer any hypothetical questions about what could’ve happened but didn’t happen. I’m looking forward to being able to discuss all of the issues pertaining to this after the conclusion of the Accountability Review Board. My responsibility was to appoint such a board, which I did immediately. They have been hard at work. We are hoping that they will be finished with their work very soon, and we intend to make the results of their investigation publicly, and at that time I will be able to address all of these issues.

MS. NULAND: Last one this evening, (inaudible).

QUESTION: Madam Chairperson, Madam Secretary, can Rwanda be part of the solution in Kivu if it continues to deny that it’s part of the problem, specifically its support for M23? And do you think President Kagame has any personal responsibility to bear on what’s going on there now?

CHAIRPERSON DLAMINI-ZUMA: Well, our approach to this matter is that it doesn’t help us in fingerprinting – finger-pointing. We just need a solution. And we met in Kampala on Saturday, the summit took decisions that the M23 must be out, that there must be a special force, a neutral force to deal with that area, and that President Kabila should listen and evaluate the concerns of the M23. And so for us, what is important is to get that resolution of that problem, and the rest will be taken care of because Rwanda is part of the Great Lakes. They have taken a decision that there must be a neutral force there. And Rwanda was there. It supported that decision that M23 must move out of Goma. Rwanda was there. It supported that decision. So for us, that’s what is important.

SECRETARY CLINTON: And I would fully support the Chairperson’s comments. We have consistently called on all parties, including Rwanda, to play a positive role in helping to bring about a peaceful resolution of this conflict. And that includes ending any and all support for the M23. Any military assistance from anyone to the M23 is in violation of the UN arms embargo. And we were very heartened by the results of the Kampala summit. And as the Chairperson said, now we want to see it implemented. There was an agreement. There’s a path forward. But it is up to the parties now to hold themselves accountable, and each other, for acting on those agreements.

U.S. Supports Pushback Against Lord's Resistance Army

WASHINGTON, April 25, 2012 - The United States is part of a successful effort to help counter the Lord's Resistance Army in Central Africa, but a four-pillared approach to neutralizing the terrorist group must continue, senior defense, diplomatic and aid officials told senators here yesterday.

That approach, officials explained, includes increasing protection for civilians in LRA-affected areas, apprehending and removing Joseph Kony and other LRA leaders, disarming, demobilizing and reintegrating remaining LRA fighters, and sustaining humanitarian relief to affected areas.

Amanda J. Dory, deputy assistant Secretary of Defense for African affairs, joined Donald Yamamoto, principal deputy assistant Secretary of State for African affairs, and Earl Gast, U.S. Agency for International Development assistant administrator for Africa, in testimony before the Senate Foreign Relations Committee's African Affairs Subcommittee yesterday.

The LRA is composed mostly of kidnapped children forced to conduct Kony's terrorist tactics over the past 20 years, administration officials have said. Tens of thousands of people have been murdered and as many as 1.8 million have been displaced by the LRA, they said.
President Barack Obama announced April 23 that a U.S. military advise-and-assist mission to Central Africa, begun in October, will remain in place with periodic review.
"Our advisers will continue their efforts to bring this madman to justice and to save lives," the president said in announcing the mission's extension.
The 100-member U.S. team of trainers is working to help nations affected by the LRA to "help realize a future where no African child is stolen from their family and no girl is raped and no boy is turned into a child soldier," Obama said.
Dory described U.S. contributions to the effort, which include training local forces and assisting in intelligence and logistics coordination.
"The militaries of Uganda, the Central African Republic, South Sudan and the Democratic Republic of the Congo, in collaboration with the African Union, continue to pursue the LRA and seek to protect local populations," she said. "They are leading this effort."

U.S. advisors in Uganda synchronize and oversee the department's counter-LRA efforts and coordinate with Ugandan forces, she said, while other U.S. service members work in field locations with forces from Uganda, the Central African Republic and South Sudan.

"U.S. advisors have helped to set up operations fusion centers to enable daily coordination, information sharing and tactical coordination," she said. "[They] are also integrating local civilian leaders into the work of the partner forces to improve the effectiveness of the civil-military relations."
Yamamoto said the State Department's role in the counter-LRA mission largely involves multinational coordination.

"We are coordinating closely with the United Nations peacekeeping missions in the region, especially to promote civilian protection," he said. "We have encouraged the U.N. to scale up its efforts when possible. We are also working very closely with the African Union to increase its efforts to address the LRA."
Gast said USAID has worked in Africa since the late 1980s to help communities build security, to reintegrate children formerly abducted by the LRA, and to strengthen economic development in affected areas.
"As the conflict first began to exact severe economic losses, cause mass displacement and weaken governance in Northern Uganda, USAID focused on providing lifesaving assistance to those affected by the conflict," Gast said. "When the LRA was finally driven out of Northern Uganda, our programs shifted from relief to recovery and then to longer-term development, which is taking place now."

Dory noted the LRA operates in a remote and rugged zone that includes parts of several countries. U.S. forces have effectively only been in the area since December and January, she said, but they have seen results from their efforts.

"We believe the U.S. military advisors have established a good foundation and made initial progress, especially considering the complexity of the operating environment, the number of partners involved and the remoteness of the operational areas," Dory said. "We will continue to monitor the situation closely with our interagency partners to ensure our support is having the intended impact."

STATE DEPARTMENT FACT SHEET ON "THE LORD'S RESISTANCE ARMY" (LRA)

The Lord’s Resistance Army (LRA) has been active since 1986, making it one of Africa’s oldest, most violent, and persistent armed groups. The LRA was formed in northern Uganda to fight against the Government of Uganda, and operated there from 1986 to 2006. At the height of the conflict, nearly two million people in northern Uganda were displaced.

Lacking public support, the LRA resorted to forcible recruitment to fill its ranks. A 2006 study funded by UNICEF estimated that at least 66,000 children and youth had been abducted by the LRA between 1986 and 2005. According to that study, most of these children were only held for a brief period of time and then released or escaped, but others were forced to become child soldiers or sex slaves and commit unspeakable acts.

Under increasing pressure, LRA’s leader Joseph Kony ordered the LRA to withdraw completely from Uganda in 2005 and 2006 and move west into the border region of the Democratic Republic of the Congo (DRC), the Central African Republic (CAR), and what would become the Republic of South Sudan. The LRA has continued to operate in this border region to date.

With the LRA’s departure, northern Uganda has undergone a significant positive transformation. More than 95% of the people who once lived in displacement camps have left to rebuild their lives. The United States has played a leading role, among donors, in supporting this Uganda-led recovery process.

Since 2000, more than 12,000 former LRA fighters and abductees have left the group and been reintegrated through Uganda’s Amnesty Commission. Many more have escaped and returned to their communities without going through reception centers.

From 2006 to 2008, representatives of the Government of Uganda and the LRA participated in negotiations in Juba, South Sudan, mediated by Southern Sudan officials. The U.S. State Department sent a senior official to support the talks. The negotiators finalized a peace agreement, but Joseph Kony refused on multiple occasions to sign. During 2008, the LRA increased attacks and abductions in the DRC and CAR. In late 2008, regional leaders agreed to undertake new military operations against the LRA. Since then, the Ugandan military has continued to pursue LRA groups across the region, in coordination with the other militaries.

As a result of military pressure and defections, the LRA’s core fighters have been reduced to an estimated 150-200, in addition to an unknown number of accompanying abductees, women and children. However, the LRA retains the capacity to cast a wide shadow across the region because of its brutality and the fear it arouses in local populations. According to the UN, there were 278 reported attacks attributed to the LRA in 2011. The UN estimates that more than 465,000 people in CAR, the DRC, and South Sudan were displaced or living as refugees during 2011 as a result of the LRA threat.

In 2005, the International Criminal Court issued arrest warrants for the LRA’s top leader Joseph Kony and four other top commanders – Vincent Otti, Okot Odhiambo, Dominic Ongwen, and Raska Lukwiya – for war crimes and crimes against humanity. Otti and Lukwiya are now believed to be dead, but the others remain at large.

The United Nations Security Council has repeatedly condemned ongoing attacks carried out by the LRA and commended the important efforts undertaken by militaries in the region to address the threat posed by the LRA. The UN has peacekeeping operations in South Sudan and the DRC whose mandates include helping to address the LRA.

On November 22, 2011, the African Union formally designated the LRA as a terrorist group and authorized an initiative to enhance regional cooperation toward the elimination of the LRA. The U.S. State Department has included the LRA on its “Terrorist Exclusion List” since 2001. In 2008, Joseph Kony was designated by the State Department as a “Specially Designated Global Terrorist,” under Executive Order 13324.

Over the past decade (FY 2002-FY 2011), the United States has provided more than $560 million in humanitarian assistance specifically benefiting LRA-affected populations in Uganda, CAR, the DRC and Sudan, in addition to countrywide assistance in the affected countries that could benefit individuals affected by LRA violence.
