'NORAD NEXT'

U.S., Canada Think Ahead to 'NORAD Next'

PETERSON AIR FORCE BASE, Colo., Jan. 7, 2013 - More than a half century since it was established to confront the Cold War threat, North American Aerospace Defense Command is at a new crossroads as officials in the United States and Canada determine the capabilities it will need to confront emerging challenges and threats in the decades ahead.

Members of the Permanent Joint Board of Defense, the highest-level defense and security forum between the two countries, discussed the so-called "NORAD Next" concept during their meeting in Colorado Springs, Colo., last month, Royal Canadian Air Force Lt. Gen. J.A.J. "Alain" Parent, NORAD's deputy commander, told American Forces Press Service.

The discussion was a first step toward a broad analysis to identify what threats and challenges the United States and Canada will face in the 2025-to-2030 timeframe -- and what steps need to be taken now to prepare for them, Parent said.

NORAD Next is largely a vision at this point, Parent emphasized, and any changes to the binational NORAD agreement would require both countries' approval. But vast changes in the security landscape have produced broad agreement that NORAD must continually evolve to meet challenges to North America, he said.

Throughout its history, adaptation has been one of NORAD's hallmarks, enabling it to remain relevant even as the geostrategic environment has changed, Parent noted.

The United States and Canada formed North American Air Defense Command in 1958, merging their air defense capabilities to provide a continental-scale ability to detect and intercept Soviet bombers, presumably carrying nuclear weapons, explained Lance Blyth, the NORAD command historian.

That same framework -- warning systems that ran across Canada and Alaska, fighter bases with interceptor aircraft and a command-and-control system that tied them together and with national command authorities -- adapted as intercontinental ballistic missiles became the more pressing threat, Blyth said.

This expanded mission led to NORAD's name change in 1981 to North American Aerospace Defense Command.

The command continued to provide aerospace warning and control for North America after the fall of the Berlin Wall, but also began to contribute its capabilities to counterdrug missions, predominantly focusing on airborne trafficking into the United States and Canada.

NORAD's sensors and interceptors supported this new law enforcement mission, providing intelligence to law enforcement agencies and serving as a catalyst for the close interagency collaboration that underpins NORAD's operations today, Blyth explained.

The 9/11 terrorist attacks shook NORAD to its very core, challenging the bedrock assumption on which it had been founded: that an attack on either of the two countries would emanate from outside their borders, he said.

Within hours of the attack, NORAD already had the go-ahead to stand up Operation Noble Eagle. Under this ongoing homeland defense mission, NORAD monitors and intercepts aircraft of interest within both U.S. and Canadian territory, and provides security support for major events ranging from G8 summits, political conventions to even the Super Bowl.

Operation Noble Eagle represented a sea change at NORAD, broadening its focus for the first time to address both internal as well as external threats against North America.

"We weren't postured to be looking inside the continent as we are today," Royal Canadian Air Force Brig. Gen. A.D. "Al" Meinzinger, deputy director of strategy in the NORAD and U.S. Northern Command policy and plans directorate, told American Forces Press Service. "But as a consequence of 9/11, we stood up a whole enterprise to be poised and positioned to deal with the internal threats," he added. "And we all understand that we need to be ready to respond on a moment's notice."

Another major step in that evolution took place in 2006, when U.S. and Canadian authorities expanded NORAD's mandate to address seaborne threats. This maritime-warning mission applies the command's capabilities to identify and track vessels of interest approaching either country's coast, and passing that intelligence to authorities that would intercept them.

More than a decade after 9/11, NORAD officials are widening their field of vision yet again as they discuss roles the command could play in addressing threats from a broad array of domains: air, space, sea, land and even cyberspace.

They also are working to identify what warning systems and processes will be required to address these threats, particularly as the life cycles of many of the current radars expire in the 2020-2025 timeframe.

"We need to think about what is beyond 2015, what the strategic environment will be, and what we need to be doing to move the command into that future," Meinzinger said.

NORAD Next, he said, will be the bumper sticker for that next big step in NORAD's evolution.

"NORAD Next will ensure that NORAD remains forever relevant and ever evolving," Parent said. "If we want to outpace the threats, we have to think in advance of them.

"The important thing," he continued, "is that we maintain relevancy and don't get surprises. The stakes are too big for our two counties to get surprised."

U.S. Ambassador to Canada David Jacobson and the Canadian Minister of Citizenship, Immigration and Multiculturalism Jason Kenney signed a U.S.-Canada Visa and Immigration Information-Sharing Agreement on December 13, 2012.

This agreement will enable Canada and the United States to share information from third country nationals who apply for a visa or permit to travel to either country. This will better protect the safety and security of Americans and Canadians and facilitate legitimate travel and business. Increased information sharing will support better decision-making by both countries to confirm applicants’ identities, and identify risks and inadmissible persons at the earliest opportunity. It will increase safety and security, as both countries work to identify terrorists, violent criminals, and others who pose a risk before they reach our borders. All officers working on immigration and refugee protection will be equipped with more information to make decisions. This will better protect the safety and security of Americans and Canadians alike and further facilitate legitimate travel.

The agreement authorizes development of arrangements under which the United States may send an automated request for data to Canada, such as when a third country national applies to the United States for a visa or claims asylum. Such a request would contain limited information, such as name and date of birth in the case of biographic sharing, or an anonymous fingerprint in the case of biometric sharing. If the identity matches that of a previous application, immigration information may be shared, such as whether the person has previously been refused a visa or removed from the other country. The same process would apply in reverse when a third country national applies to Canada for a visa or claims asylum. Biographic immigration information sharing is set to begin in 2013, and biometric sharing in 2014.

Under the agreement, information will not be shared regarding U.S. or Canadian citizens or permanent residents. Any information shared on travellers and asylum seekers will be handled responsibly and, as with other information sharing agreements, exchanged in accordance with relevant U.S. and Canadian laws.

U.S.-CANADA RELATIONS
The United States and Canada share two borders and their bilateral relationship is among the closest and most extensive in the world. It is reflected in the high volume of bilateral trade--the equivalent of $1.6 billion a day in goods--as well as in people-to-people contact. About 300,000 people cross between the countries every day by all modes of transport. In fields ranging from security and law enforcement to environmental protection to free trade, the two countries work closely on multiple levels from federal to local.

U.S. defense arrangements with Canada are more extensive than with any other country. The Permanent Joint Board on Defense provides policy-level consultation on bilateral defense matters and the United States and Canada share North Atlantic Treaty Organization (NATO) mutual security commitments. U.S. and Canadian military forces cooperate on continental defense within the framework of the binational North American Aerospace Defense Command (NORAD).

The Beyond the Border initiative outlines a vision for perimeter security and economic competitiveness whereby the United States and Canada work in partnerships within, at, and away from our borders to achieve enhanced security and accelerate the legitimate flow of people, goods, and services between our two countries. The United States has several successful joint law enforcement programs with Canada such as the Integrated Border Enforcement Teams (IBET), Border Enforcement Security Taskforces (BEST), and the ShipRider Integrated Cross Border Maritime Law Enforcement program. Senior leadership engages in these efforts through fora such as the Cross Border Crime Forum (CBCF), which is chaired by the U.S. Attorney General and the Secretary of Homeland Security with their Canadian counterparts. As part of the Beyond the Border Action Plan, U.S. and Canadian officials are enhancing cross-border law enforcement radio interoperability and building on the successes of programs such as IBET, BEST, and ShipRider to develop the next generation of integrated cross-border law enforcement.

U.S. Customs and Border Protection (CBP) conducts preclearance operations at eight Canadian airports, allowing air travelers to arrive at domestic terminals in the United States by screening and making admissibility decisions about U.S.-bound travelers and their accompanying goods or baggage prior to departure. The United States and Canada intend to enhance preclearance operations and expand them to also cover land, rail, and ferry/cruise travel as part of the Beyond the Border Action Plan.

The United States and Canada work together to resolve and manage transboundary environmental and water issues. A principal instrument of this cooperation is the International Joint Commission established under the 1909 Boundary Waters Treaty. Under the Columbia River Treaty, Canada and the United States jointly regulate and manage the Columbia River as it flows from British Columbia into the United States. The two countries cooperate on a range of bilateral fisheries issues and international high seas governance initiatives, and are both founding members of the Arctic Council.

The bilateral Clean Energy Dialogue is charged with expanding clean energy research and development; developing and deploying clean energy technology; and building a more efficient electricity grid based on clean and renewable energy in order to reduce greenhouse gases and combat climate change in both countries. Canada is an ally of the United States in international climate change negotiations. Canada participates in the U.S.-led Major Economies Forum on Energy and Climate; the Asia Pacific Partnership on Clean Development and Climate, which aims to accelerate the development and deployment of clean energy technologies in major industrial sectors; and the International Carbon Sequestration Leadership Forum, which researches effective ways to capture and store carbon dioxide.

The United States provides no foreign assistance to Canada.

Bilateral Economic Relations
The United States and Canada share the world's largest and most comprehensive trading relationship, which supports millions of jobs in each country. Canada is the single largest foreign supplier of energy to the United States. Recognition of the commercial viability of Canada's oil sands has made it the world's third largest holder of oil reserves after Saudi Arabia and Venezuela and is the only non-OPEC member in the top five. Canada and the United States operate an integrated electricity grid that meets jointly developed reliability standards, and they provide all of each other's electricity imports. Canadian uranium helps fuel U.S. nuclear power plants.

The North American Free Trade Agreement (NAFTA) among the United States, Canada, and Mexico aims to reduce trade barriers and establish agreed upon trade rules. It has resolved long-standing bilateral irritants and liberalized rules in several areas, including agriculture, services, energy, financial services, investment, and government procurement. The Regulatory Cooperation Council seeks to further stimulate trade by increasing regulatory transparency and cooperation between the United States and Canada and eliminating unnecessary regulatory differences and duplicative actions that hinder cross-border trade and investment.

Canada and the United States have one of the world's largest investment relationships. The United States is Canada's largest foreign investor, and Canada is the fifth-largest foreign investor in the United States. U.S. investment is primarily in Canada's mining and smelting industries, petroleum, chemicals, the manufacture of machinery and transportation equipment, and finance. Canadian investment in the United States is concentrated in finance and insurance, manufacturing, banking, information and retail trade, and other services.

Bilateral trade disputes are managed through bilateral consultative forums or referral to NAFTA or World Trade Organization (WTO) dispute resolution procedures. Canada has challenged U.S. trade remedy law in NAFTA and WTO dispute settlement mechanisms. The two countries negotiated the application to Canadian goods of "Buy American" provisions for state and local procurement under the American Recovery and Reinvestment Act. The United States has encouraged Canada to strengthen its intellectual property laws and enforcement. Canada passed an important copyright law on June 28, 2012.

Canada's Membership in International Organizations
In addition to their close bilateral ties, Canada and the United States cooperate in multilateral fora, including international efforts to combat terrorist financing and money laundering. The two countries belong to a number of the same international organizations, including the United Nations, NATO, WTO, G8, G20, Organization for Security and Cooperation in Europe, Organization for Economic Cooperation and Development, Organization of American States, and Asia-Pacific Economic Cooperation forum. Canada accepted an invitation to join the Trans-Pacific Partnership regional trade agreement being negotiated among the United States and other countries.

U.S. and Canada Announce the Release of the Beyond the Border: Statement of Privacy Principles

WASHINGTON—The United States and Canada today announced they are delivering on key commitments under the U.S.-Canada Beyond the Border Action Plan by releasing a joint Statement of Privacy Principles.  These principles reflect the commitment of the United States and Canada to protecting privacy, and underscore the importance of information sharing to the security of both nations.

“These privacy principles reflect the shared commitment of the United States and Canada to implement our Beyond the Border Action Plan,” said Attorney General Eric Holder.  “Timely and efficient information sharing between the United States and Canada is critical to the national security of both nations.  These principles reflect our two nations’ continued shared commitment to protecting our collective security without sacrificing the fundamental rights and civil liberties that both our countries value.”

“The release of these principles is an important milestone in the implementation of the Beyond the Border Action Plan,” said Secretary of Homeland Security Janet Napolitano.  “They represent both the United States’ and Canada’s commitment to sharing information, while simultaneously protecting the fundamental privacy principles upon which both our nations were built .”

The Statement of Privacy Principles concerning the provision, receipt and use of personal information exchanged between the U.S. and Canada will inform and guide all information sharing arrangements and initiatives under Beyond the Border Action Plan.  Implementing the privacy principles will promote the flow of accurate, relevant and necessary information to address shared threats to national security.

Developed collaboratively by privacy officials from the Department of Homeland Security, the Department of Justice, Public Safety Canada and Justice Canada, the privacy principles are based on commonly understood privacy protections and fair information practices; and are consistent with the laws of each country .

The United States and Canada will collaborate regularly, through the Beyond the Border Executive Steering Committee and other avenues, on the application of the Statement of Privacy Principles.

On Feb. 4, 2011, President Obama and Prime Minister Harper announced the U.S.-Canada joint declaration, Beyond the Border: A Shared Vision for Perimeter Security and Economic Competitiveness.  It articulates a shared vision where both our countries work together to address threats at the earliest point possible, while facilitating the legitimate movement of people, goods and services into our countries and across our shared border.

The Beyond the Border Action Plan consists of 32 separate initiatives.  It calls for enhancements to programs that help trusted businesses and travelers move efficiently across the border; introduces new measures to facilitate movement and trade across the border while reducing the administrative burden for business; and invests in improvements to our shared border infrastructure and technology.  By expediting lawful trade and commerce into and across our shared border, the United States and Canada seek to enhance our economic competitiveness, create jobs and support economic growth.
