EPA WILL BEGIN ASSESMENTS ON 23 COMMONLY USED CHEMCALS

EPA Announces Chemicals for Risk Assessment in 2013, Focus on Widely Used Flame Retardants

WASHINGTON
– Today, the U.S. Environmental Protection Agency (EPA) announced it will begin assessments on 23 commonly used chemicals, with a specific focus on flame retardant chemicals, in order to more fully understand any potential risks to people’s health and the environment. This effort is part of the Toxic Substances Control Act (TSCA) Work Plan which identifies commonly used chemicals for risk assessment.

Americans are often exposed to flame retardant chemicals in their daily lives; flame retardants are widely used in products such as household furniture, textiles, and electronic equipment. Some flame retardant chemicals can persist in the environment, bioaccumulate in people and animals, and have been shown to cause neurological developmental effects in animals.

"EPA is committed to more fully understanding the potential risks of flame retardant chemicals, taking action if warranted, and identifying safer substitutes when possible," said James J. Jones, Acting assistant administrator for the Office of Chemical Safety and Pollution Prevention. "Though today’s announcement represents a significant step forward on chemical safety, it’s important to remember that TSCA, this country’s chemicals management legislation, remains in dire need of reform in order to ensure that all Americans are protected from toxic chemicals in their environment."

EPA will begin evaluating 20 flame retardant chemicals, conducting full risk assessments for four of the flame retardants, three of which are on the TSCA Work Plan, and one that was the subject of an Action Plan development under TSCA. In addition, we are assessing eight other flame retardants by grouping flame retardants with similar characteristics together with the chemicals targeted for full assessment. EPA will use the information from these assessments to better understand the other chemicals in the group, which currently lack sufficient data for a full risk assessment.

EPA will also begin analyzing how eight of the 20 flame retardant chemicals transform and move in the environment. These chemicals were selected because they are likely to persist in the environment, bioaccumulate in people and/or have high exposure potential, but there are not adequate data to conduct full risk assessments.

During its review of data on flame retardant chemicals in commerce, EPA also identified approximately 50 flame retardant chemicals that are unlikely to pose a risk to human health, making them possible substitutes for more toxic flame retardant chemicals.

As EPA develops its draft risk assessments, the agency will use information that is available through a wide range of publicly available data sources. EPA also encourages submission of additional relevant information on these chemicals, such as unpublished studies and information on uses and potential exposures. This information should be submitted by May 30, 2013, to ensure that it is included in the agency’s review.

EPA WORKING TO ALLOW ACCESS TO CHEMICAL INFORMATION BUSINESSES CLAIM AS CONFIDENTIAL

Background

Under the Toxic Substances Control Act (TSCA), EPA collects a range of data, including health and safety studies on chemicals, some of which may be claimed as
Confidential Business Information (CBI) by the submitter.

The Agency uses this information to carry out a range of activities including prioritizing chemicals for review, conducting risk assessments and taking risk management action if needed. This information is equally important to entities outside the Agency including product formulators, manufacturers, state governments, communities and others.

Access to chemical safety information allows a greater understanding of the possible implications of certain chemicals and enables users to make informed chemicals-related decisions. Through these efforts, EPA is attempting to make this information available in as timely a manner as possible.

In the past, public access to many of these studies on human health and the environment had been restricted by confidential business information claims. In 2010, the Agency initiated a program to review and where appropriate challenge confidentiality claims for chemical identity. The criteria for review were that the filing needed to contain health and safety data that had been submitted to the Agency under TSCA and relate to chemicals in commerce. The FY 2011-2015 EPA Strategic Plan included a measure to review, and challenge where appropriate, more than 22,000 existing TSCA cases with CBI claims for chemical identity, potentially containing health and safety studies.

EPA continues to encourage TSCA submitters to declassify unnecessary CBI claims made in submissions under TSCA section 8(e) through the
TSCA CBI Voluntary Challenge. Additionally, EPA is reviewing certain older submissions made under TSCA sections 4 and 8(d) to verify that these cases contain CBI claims for chemical identity and health and safety studies. Finally, EPA is reviewing the non-CBI data recently collected under the Chemical Data Reporting Rule to determine if there are related cases with health and safety data and the chemical identity claimed as CBI that can be declassified.

The effort supports both legitimate CBI claims and protecting the public’s right to know about potential risks posed by widely-used chemicals. In addition to reviewing existing cases, all new cases containing health and safety data submitted under TSCA that claim the chemical identify as CBI and are chemicals in commerce are being reviewed upon receipt to determine if the claim is appropriate.

EPA PROPOSES ELECTRONIC REPORTING OF SOME INFORMATION UNDER TOXIC SUBSTANCES CONTROL ACT

EPA Proposes Rule to Require Electronic Reporting for Chemical Information
WASHINGTON
— The U.S. Environmental Protection Agency (EPA) has announced a proposed rule to require electronic reporting for certain information submitted to the agency under the Toxic Substances Control Act (TSCA).The action is an important milestone in the agency’s effort to increase transparency and public access to chemical information in order to help Americans protect their health and environment. Electronic reporting will increase the speed with which EPA can make information publicly available, increase accuracy, and provide the public with quick and easier access to chemical information.
“Administrator Lisa P. Jackson is committed to strengthening EPA's chemicals management program and increasing the public’s access to chemical information,” said Jim Jones, acting assistant administrator for EPA’s Office of Chemical Safety and Pollution Prevention. “The agency is also committed to reducing reporting burdens and paper-based reporting in favor of electronic reporting. These measures will streamline the reporting process and reduce the administrative costs.”

Today’s proposed rule would require electronic reporting rather than paper-based reporting for various TSCA actions including submission of information relating to chemical testing, health and safety studies, and other information. When final, 
EPA will only accept data, reports, and other information submitted through EPA’s Central Data Exchange, a centralized portal that enables streamlined, electronic submission of data via the Internet. The agency will be soliciting comments on this proposed rule for 60 days.

Over the coming months, the agency will offer a number of opportunities for potential users to become familiar with the new requirements. These opportunities will include an initial webinar to introduce the web-based electronic reporting tool, follow-up webinars and testing of specific applications, and opportunities for submitters and others to provide feedback to the agency on their experiences using the tool before its release.
