Departments of Justice, Labor and Homeland Security Announce Phase II of Anti-Trafficking Coordination Team Initiative

Phase II Will Build on Momentum of Highly Effective Phase I to Further Enhance Interagency Anti-Trafficking Efforts

The Departments of Justice, Labor (DOL) and Homeland Security (DHS) today announced the launch of Phase II of the Anti-Trafficking Coordination Team (ACTeam) Initiative aimed at streamlining federal criminal investigations and prosecutions of human trafficking offenses.

Phase II ACTeams will be convened in up to six selected districts around the country, following a competitive, nationwide, interagency selection process.  The ACTeams, comprised of federal prosecutors and investigators representing multiple federal enforcement agencies, will implement a joint strategic action plan to develop high-impact federal investigations and prosecutions, vindicate the rights of human trafficking victims, bring traffickers to justice and dismantle human trafficking networks.

“Human traffickers prey on some of the most vulnerable members of our society to exploit them for labor, for sex and for servitude of all kinds,” said Attorney General Loretta E. Lynch.  “Their crimes, appropriately described as modern-day slavery, have no place in a nation that has overcome the scourge of slavery.  That’s why the Department of Justice is committed—and I am personally determined—to hold human traffickers accountable, provide support to trafficking survivors, and stand up for the rights and the dignity that they deserve.”

“Labor trafficking affects workers who are vulnerable to exploitation for a number of reasons, who may not know their workplace rights, and may be afraid to raise their voices,” said Secretary Thomas E. Perez of DOL.  “The challenges we face as a nation and a government demand unprecedented levels of interagency collaboration.  Through these ACTeams, we’re bringing our respective departments’ collective resources and expertise to bear, building a whole even greater than the sum of our individual parts.  DOL will remain a vigorous and unfaltering partner during phase II.  Together we can ensure workers receive the wages they’ve earned, restore victims’ basic human rights and bring traffickers to justice.”

“The ACTeam Initiative has been an important tool in our collective ability to combat sex trafficking, forced labor and domestic servitude here in the United States,” said Secretary Jeh Johnson of DHS.  “This is not a problem that we can afford to ignore which is why, under a banner of shared responsibility and collaboration, the Departments of Justice, Labor and Homeland Security are recommitting ourselves to the fight against human trafficking by expanding the ACTeam Initiative.  Through the unified voice of the Blue Campaign, the Department of Homeland Security will continue to combat human trafficking through the guiding philosophy that we are at our best when we work together.”

These departments collaborated to develop the ACTeam Initiative to streamline rapidly expanding human trafficking enforcement efforts, focusing on forced labor, international sex trafficking and sex trafficking of adults by force, fraud and coercion.  Project Safe Childhood and the Innocence Lost National Initiative continue to focus on sex trafficking of minors and sexual exploitation of minors.

Drawing together federal prosecutors and federal agents from multiple investigative agencies, ACTeams streamline coordination on the front lines of federal human trafficking investigations and prosecutions, while also enhancing collaboration between front-line enforcement efforts and national human trafficking subject matter experts in the Justice Department’s Human Trafficking Prosecution Unit, Executive Office of U.S. Attorneys and FBI Civil Rights Unit, DHS’s Immigration and Customs Enforcement-Homeland Security Investigations, DOL’s Wage and Hour Division and the Office of the Inspector General.  In 2011, the Attorney General and the Secretaries of DHS and DOL announced Phase I of the ACTeam Initiative and the designation of six Phase I Pilot ACTeam sites in Atlanta; El Paso, Texas; Kansas City, Missouri; Los Angeles; Memphis, Tennessee; and Miami, following a rigorous interagency selection process.

During the ACTeam Phase I period, Fiscal Years 2012-2013, federal human trafficking prosecutions involving forced labor, international sex trafficking and sex trafficking of adults rose by 35 percent nationwide, reflecting strong partnerships among U.S. Attorneys’ Offices, the Civil Rights Division’s Human Trafficking Prosecution Unit, federal, state and local law enforcement agencies, and non-governmental victim assistance organizations and task forces led by U.S. Attorneys’ Offices.

The ACTeams played a significant role in leading these nationwide advances.  In ACTeam Districts, prosecutions of forced labor, international sex trafficking and adult sex trafficking rose even more markedly than they did nationally, due to the force-multiplier effect of interagency commitment to implementing coordinated, joint anti-trafficking strategies and due to advanced training, expertise and operational support provided to the Phase I ACTeams.  Comparing federal forced labor, international sex trafficking and adult sex trafficking prosecutions during the ACTeam Phase I period of Fiscal Years 2012-2013, to the pre-Phase I period of Fiscal Years 2010-2011:

Cases filed increased by:

119 percent in ACTeam Districts,
18 percent in non-ACTeam Districts; and
35 percent nationwide.
Defendants charged increased by:

114 percent in ACTeam Districts,
12 percent in non-ACTeam Districts; and
28 percent nationwide.
Defendants convicted increased by:

86 percent in ACTeam Districts,
14 percent in non-ACTeam Districts; and
26 percent nationwide.

LABOR DEPARTMENT SAYS SUPPORT OF HUMAN TRAFFICKING VICTIMS IS EXPANDING

US Labor Department expands its support of victims
of human trafficking and other crimes
Department will begin to certify 'T' visas and expand 'U' visa certifications

SEATTLE — U.S. Secretary of Labor Thomas E. Perez today announced that the labor department's Wage and Hour Division will begin to exercise its authority to certify applications for trafficking victims seeking "T" visas. The division will also certify "U" visa requests when it detects three additional qualifying criminal activities in the course of its workplace investigations: extortion, forced labor, and fraud in foreign labor contracting. The announcement was made at a roundtable on new American integration in Seattle hosted by OneAmerica.

"The Labor Department is taking important steps to provide more support for workers who have been exploited significantly because of their immigrant status," said Perez. "These actions will protect workers, and help law enforcement protect our communities and public safety."

These efforts build on the work the department began 2011, when it started to certify U visa applications for victims of five qualifying crimes found in its workplace investigations: involuntary servitude, peonage, trafficking, obstruction of justice and witness tampering. By expanding its U visa certifications to include extortion, forced labor, and fraud in foreign labor contracting and by completing T visa certifications, the department is providing additional support to workers it believes are victims of the relevant crimes and are willing to cooperate with law enforcement.

The Wage and Hour Division enforces several critical federal workplace laws, including the federal minimum wage and overtime laws. Many Wage and Hour investigations take place in industries that employ vulnerable workers so the division is often the first federal agency to make contact with these workers and detect workplace exploitation. Such activities may then be referred to the other appropriate authorities.

These efforts will assist significantly the victims of these crimes who qualify, and who are seeking immigration relief from the Department of Homeland Security and access to the range of victim services they need to recover and rebuild their lives.

FACT SHEET: Support for the Alliance for Prosperity in the Northern Triangle

Vice President Biden traveled to Guatemala March 2-3 for two days of meetings with the Presidents of Guatemala, Honduras, El Salvador, and Inter-American Development Bank President Luis Alberto Moreno, to advance implementation of the “Plan of the Alliance for Prosperity in the Northern Triangle” announced last November in Washington, DC.  The Vice President was accompanied by State Department Counselor Thomas A. Shannon, Assistant Attorney General Leslie Caldwell, Under Secretary of Commerce Stefan Selig, USAID Associate Administrator Mark Feierstein, Southcom Commander General John Kelly, and Inter-American Development Bank U.S. Executive Director Mark Lopes.

This week's meetings provided an opportunity for the leaders to discuss steps to stimulate economic growth, reduce inequality, promote educational opportunities, target criminal networks responsible for human trafficking, and help create governance and institutions that are transparent and accountable.

During working group meetings on March 3, Northern Triangle leaders committed in a Joint Statement to specific actions to advance implementation of the Alliance for Prosperity, in cooperation with the United States and the Inter-American Development Bank.

Specific commitments made by the leaders included the following:

- The United States and Northern Triangle governments agreed to hold a regional security dialogue in May 2015;

- The Northern Triangle governments agreed to expand centers in high-crime neighborhoods for at-risk youth to acquire job and life skills and participate in recreational activities in a safe environment;

- They agreed to create independent governmental auditing mechanisms by the end of 2015 to help combat corruption;

- Honduras will introduce a plan for police service reform by June 2015;

- Honduras will recruit, train, and deploy an additional 6,000 police over the next three years;

- El Salvador will present a bill criminalizing bulk cash smuggling by June 2015;

- Guatemala will introduce legislation to transition from an inquisitorial to an accusatorial judicial system by December 2015;

-  The Northern Triangle countries agreed to diversify their energy matrix in 2015, to include promoting the completion of a gas pipeline from Mexico to Central America;

- They agreed to promote an integrated, efficient energy market by modifying the regulations governing the regional electricity market by 2016;

- The leaders agreed to hold advisory meetings by Summer 2015 to promote private investment;

- Guatemala and Honduras agreed to implement their recently announced Customs Union by December 2015;

- The Northern Triangle governments agreed to establish a government “single window” for foreign investors by December 2015;

- They agreed to develop public investment plans for the areas of greatest economic need by April 2015;

- They agreed to develop education investment plans focusing on pre-school, secondary, and vocational schools by the end of 2016;

- The Northern Triangle leaders agreed to develop specific strategies for women’s economic empowerment by 2016;
 
- Guatemala will create specialized anti-money laundering, asset forfeiture, and cybercrime units by June 2015;

- The three Northern Triangle countries agreed to develop a plan to professionalize civil services beginning in 2015;

- They committed to strengthen their tax base through better tax administration, more robust tax authorities, and tax code simplification.

Foreign Ministers from the three countries also agreed to present a detailed implementation roadmap for the Alliance for Prosperity at the Inter-American Development Bank in Washington on March 16, 2015. The leaders also agreed to meet during the first half of 2015 with private sector and civil society stakeholders to receive feedback on the roadmap.

In addition to the President’s Fiscal Year 2016 budget request which included $1 billion for Central America, the Vice President announced that the Administration would work with Congress to increase assistance to the region in Fiscal Year 2015.

SECRETARY KERRY'S REMARKS ON ISIL'S TREATMENT OF WOMEN AND GIRLS

Just days after we saw the best of humanity when Malala Yousafzai and Kailash Satyarthi were awarded the Nobel Peace Prize, we again confront the worst of inhumanity in ISIL. No one needed a reminder of ISIL’s depravity and evil. But now we have the latest example.

ISIL now proudly takes credit for the abduction, enslavement, rape, forced marriage, and sale of several thousand Yezidi and other minority women and girls—some as young as 12 years old. Just as despicably, ISIL rationalizes its abhorrent treatment of these women and girls by claiming it is somehow sanctioned by religion. Wrong. Dead wrong.

ISIL does not represent Islam and Islam does not condone or honor such depravity. In fact, these actions are a reminder that ISIL is an enemy of Islam. The international community and religious leaders of all faiths have strongly and repeatedly condemned ISIL’s horrific acts; we urge them to reiterate their commitment by condemning in the strongest possible terms the commodification of women and children as spoils of war, including through their subjection to horrific physical and sexual violence, intimidation, and deprivation of liberty.

These acts transgress all definitions of human dignity and those individuals responsible must be identified and held fully accountable. Ambassador-at-Large for Global Women’s Issues Cathy Russell said it best: “Such viciousness against innocents exposes ISIL's blatant rejection of the most basic progress we have made as a community of nations and the universal values that bind civilization.” The United States will not stand by as ISIL uses fear, violence and oppression to achieve its goals.

To stop ISIL’s campaign of terror and horror against the Syrian and Iraqi people, we remain steadfast in our efforts to lead the international coalition to degrade and defeat ISIL. The United States will keep tracking ISIL’s abduction, enslavement, sale, rape, forced marriage, and abuse of women and girls. We will keep working with the new Government of Iraq to respond to ISIL’s brutality against women and girls from all communities in Iraq, including vulnerable minority populations.

The International Labor Organization has declared June 12, World Day Against Child Labor.
As a father and grandfather, I know there is no feeling like any other than to hold your child or grandchild for the first time. No parent should ever have to look at a tiny infant and fear that one day that child would be a victim of exploitative child labor. No grandparent should ever fear that they will lose their grandchild to a sweatshop. But that’s precisely the reality today for millions the world over.

Just think about it: roughly 168 million boys and girls throughout the world are involved in child labor. That exceeds the entire population of Russia. More than half of these children are laboring in hazardous conditions – sewing shirts in cramped factories, seeding and harvesting cotton fields in oppressive heat, or forced to carry a rifle in a war they don’t understand. Many never get to attend school, adult responsibilities are forced on them at a young age, and many more are forced to grow up too fast, simply to help provide for their families. Combating these challenges is a major focus of the State Department’s mission. If we’re going to break the chains of poverty and abuse that make children so vulnerable, then we must promote internationally recognized worker rights.

That’s why we use our annual reports, including the Human Rights Report and Trafficking in Persons Report, to bring these critical issues to light. It’s why we work with other government agencies and our partner countries to empower civil society with tools that make a difference for children and their families. And it’s why this year we support the ILO in focusing on social protection as a way to keep children in school and out of the workplace.

DARPA Sows Seeds of Technological Surprise, Director Says

WASHINGTON, April 30, 2014 – Many of the advances that contribute to national security resulted from early investment in developing new technologies, the director of the Defense Advanced Research Projects Agency told Congress yesterday.

Dr. Arati Prabhakar represented the Defense Department at a Senate Appropriations Committee hearing called to address concern that the national investment in research and development had shrunk since 2001, along with the education pipeline for young scientists and engineers.

The directors of the Office of Science and Technology Policy of the Executive Office of the President, the National Science Foundation, the National Institutes of Health and the Energy Department also testified at the hearing.

“DARPA is part of Defense Department science and technology investments,” Prabhakar said. “We're also part of this much larger national ecosystem for R&D. But within those communities, we have one very specific role: to make the pivotal early investments that change what's possible so we can take big steps forward in our national security capabilities.”

DARPA’s output is technology, but the organization counts its mission complete only when the technologies change outcomes, she added.

“Every time a stealth fighter evades an air defense system, every time a soldier on the ground is able to place himself precisely with GPS and get the data he needs, every time a radar on an aircraft carrier allows us to see a threat to a carrier strike group before it sees us -- that's when we count our mission complete,” Prabhakar said.

In every case, DARPA made a pivotal early investment that showed the technologies were possible, and what followed from that, Prabhakar said, was equally important.

“That was the investment, often by our partners in other parts of the Defense Department and the military services -- their science and technology investments, their development investments or their acquisition programs,” the director said. “Of course,” she added, “many in industry were involved deeply in those efforts, and ultimately to make those technologies into real capabilities for our warfighters.”

Along the way, as DARPA focused on its mission of investments for national security, the organization’s scientists and engineers planted some of the seeds that formed the technology base that the U.S. commercial sector has built layer on layer above the foundation, Prabhakar said.

“Every time you pick up your cell phone and do something as mundane and miraculous as check a social networking site, you're living on top of a set of technologies that trace back to that early work we did,” she added. “Public investment laid that foundation. Billions of dollars of private investment and enormous entrepreneurship is what built those industries and ended up changing how we live and work with these technologies.”

DARPA’s mission of creating breakthrough technologies for national security is unchanged across more than five decades, she told the panel, but the world in which DARPA invests and pursues its mission continues to change, and so do the things DARPA does that reflect the national security and technology context in which the organization must operate today.

“In one arena, we see information at massive scale affecting every aspect of national security,” the director said. “So if you look in our portfolio today, you will find game-changing investments in cyber and in big-data programs.” One example is work DARPA is doing to tackle the networks that drive human trafficking around the world, she added.

In another arena, Prabhakar said, DARPA is looking at what's happening with the cost and complexity of military systems today.

“We recognize that [such systems] are becoming too costly and too inflexible to be effective for the next generation of threats we will face around the world,” Prabhakar explained, “so at DARPA we are investing in programs that are fundamentally rethinking complex military systems.”

DARPA is investing in technology its experts believe will lead to powerful new approaches for radar, communications, weapons and navigation, she said.
“And in a range of research areas, we can see the new seeds of technological surprise,” Prabhakar said. “One example is where biology is intersecting with engineering today, and in areas like that, we are making investments that will lead to new technologies like synthetic biology and neurotechnology.”
Another expert who testified before the committee, National Institutes of Health Director Dr. Francis S. Collins, mentioned a breakthrough neuroscience project that Stanford University is working on with funding from NIH and DARPA and the National Science Foundation.

“Traditionally, researchers have studied the postmortem brain by cutting a specimen into slim slices. While all that slicing generates neat, two-dimensional images, it also makes it impossible to reconstruct the connections of the brain's tens of billions of neurons,” Collins said. “What if we could study the details of the wiring and the location of specific proteins in transparent 3-D?

“Using a chemical cocktail,” he continued, “researchers at Stanford University -- supported by NIH, NSF and DARPA -- have figured out a way to do just that. They've dubbed their technique ‘Clarity,’ and in an extraordinary technical feat, the team made possible a 3-D tour of an intact mouse brain illuminated by a green dye that marks the neurons.”

Clarity is now being applied to human brains, he added, and undoubtedly will advance the BRAIN Initiative, a research effort unveiled by President Barack Obama and Collins in April 2013. In his State of the Union message last year, the president addressed research and development and its value to the nation.
“If we want to make the best products, we also have to invest in the best ideas,” Obama said. “Every dollar we invested to map the human genome returned $140 to our economy -- every dollar. Today, our scientists are mapping the human brain to unlock the answers to Alzheimer’s. They’re developing drugs to regenerate damaged organs, devising new material to make batteries 10 times more powerful.
“Now is not the time to gut these job-creating investments in science and innovation,” Obama added. “Now is the time to reach a level of research and development not seen since the height of the space race.”

During her testimony yesterday, Prabhakar also discussed the nature of the world today and its relation to research and development.

“In many ways we are living in very challenging times,” she said. “Technology is getting more and more complex, [and] it's moving at a very rapid pace. Other nations are jockeying for position in global affairs, and many of them … are making their own aggressive moves to build their own science and technology capabilities.”

Meanwhile, here at home, she added, many are dealing with constrained resources, and many agencies are dealing with the corrosive effects of sequestration.

“But when I step back and look at what we have done over many decades in this country, I would observe that we have had a long and very successful commitment to investing in R&D as a nation,” the director told the panel. “And when we make that investment in R&D, we are investing in two things that are deeply American.”
One is the kind of creativity sparked by the open society that is the hallmark of the United States, she said, and in this case the nation is investing in the creativity of its scientists and engineers.

“The second thing is this drive to create a better future,” Prabhakar added. “And in a sense, this is the most productive kind of restlessness you could possibly imagine.”

WOMAN PLEADS GUILTY IN CASE OF HOLDING PERSON FOR FORCED LABOR IN RESTAURANT

Minnesota Woman Pleads Guilty to Human Trafficking for Holding Victim in Forced Labor in Restaurant

Tieu Tran, 59, of Mankato, Minn., pleaded guilty to one count of forced labor trafficking in the U.S. District Court for the District of Minnesota, the Justice Department announced today.  Tran is the former owner and manager of Nails By Jordan, a nail salon located in Mankato.

According to evidence presented in court proceedings and documents, in 2008, Tran recruited a woman from Vietnam to travel to the United States using false promises of legal immigration status and a high-paying job.  In reality, Tran smuggled the victim and two other Vietnamese nationals across the southern U.S.-Mexico border, imposed a significant debt upon the victim and forced the victim to pay down the smuggling debt by working at Tran’s son’s Vietnamese restaurant, Pho Saigon, in Mankato.

During the plea proceedings, Tran admitted to compelling the victim to work long hours without paying her as promised, using a scheme, plan and pattern of non-violent coercion.  This included manipulation of debts, isolation and verbal intimidation to hold the victim in fear, knowing that the victim was without legal status and money, did not have the ability to speak English, feared losing her family home in Vietnam to creditors and had nowhere else to turn for subsistence.

“This defendant preyed on vulnerable victims and exploited them for her profit,” said Acting Assistant Attorney General Jocelyn Samuels for the Civil Rights Division.  “Traffickers routinely use schemes of non-violent coercion to exploit victims by manipulating the victims’ debts, fears of immigration consequences, linguistic isolation and other vulnerabilities.  The Civil Rights Division is committed to seeking justice on behalf of victims of human trafficking and to holding human traffickers accountable”

“Human trafficking degrades the dignity of humanity and strikes at the heart of individual equality and freedom,” said U.S. Attorney Andy Luger for the District of Minnesota.  “The U.S. Attorney’s Office for the District of Minnesota will aggressively prosecute those who seek to capitalize on human frailty through such conduct.”

“ The FBI, in conjunction with its law enforcement partners, remains steadfast in its commitment to eradicate human trafficking,” said Special Agent in Charge J. Chris Warrener of the FBI’s Minneapolis Field Office.  “Human trafficking is an insidious crime which impacts not only its victims, but society as a whole.  Detecting and bringing to justice those who perpetrate these schemes will always be a top priority for law enforcement. ”
 
Tran faces a statutory maximum sentence of 20 years in prison and a $250,000 fine.  As part of her plea agreement, Tran agreed to nullify all debts imposed upon the victim, as well as similar debts imposed upon seven other individuals believed to be under similar circumstances.

This case was investigated by the FBI and is being prosecuted by Trial Attorney William Nolan of the Civil Rights Division’s Human Trafficking Prosecution Unit and Assistant U.S. Attorney David Steinkamp of the U.S. Attorney’s Office for the District of Minnesota.

STRATEGIC ACTION PLAN ON SERVICES FOR HUMAN TRAFFICKING VICTIMS RELEASED BY WHITE HOUSE

Rebuilding Lives for Victims of Human Trafficking

In recognition of National Slavery and Human Trafficking Prevention Month, the White House has released the first-ever Federal Strategic Action Plan on Services for Victims of Human Trafficking in the United States. The plan lays out a five-year path for increased coordination, collaboration, and capacity across the federal government and in partnership with other governmental and nongovernmental entities. It describes the steps that federal agencies will take to ensure that victims of human trafficking in the United States are identified and have access to the services they need to recover and to rebuild their lives. At the department, that means enhancing the ability of Wage and Hour investigators to detect potential cases and refer them to law enforcement partners. It also means enhancing the public workforce system's ability to provide employment and training services to survivors. The plan builds on commitments expressed by President Obama to provide support to trafficking victims, whom he addressed when he said, "We see you. We hear you. We insist on your dignity. And we share your belief that if just given the chance, you will forge a life equal to your talents and worthy of your dreams"

DEFENSE DEPARTMENT OFFICIALS TAKING STEPS TO COMBAT HUMAN TRAFFICKING

DOD Raises Awareness of Human Trafficking

WASHINGTON, Jan. 15, 2014 – Defense Department officials have a zero-tolerance level for human trafficking and have stepped up awareness and education efforts to curb the crime overseas.

In an interview with American Forces Press Service and the Pentagon Channel, Brian Chin -- a program manager for the department’s effort to combat human trafficking, said DOD is broadening its training for those who work in contracting, acquisition and law enforcement, and that a yearly general course on how to recognize human trafficking has been mandatory for DOD civilians since 2005.
Chin works out of Qatar and oversees the program in Southwest Asia and the U.S. Central Command area of operations.

DOD defines human trafficking as the use of force, fraud or coercion to recruit, harbor, transport or obtain a person for commercial sex or labor services, Chin explained.

Combating human trafficking is not a war waged alone within DOD, he noted.
“The response to human trafficking requires a collaborative approach within all of DOD’s components and services,” Chin said, as well as working with agencies, such as the departments of State and Homeland Security to put a stop to the crimes of slavery and prostitution.

“A lot of our training is designed to sensitize our folks to realize that [a victim] is not just someone who’s serving our food, cleaning the barracks or picking up refuse around the bases that could be someone who’s there against their will and is being held in circumstances that fit [DOD’s] criteria for human slavery,” he said.
Victims of human trafficking can be difficult to identify, Chin said, because usually no physical indicators of coercion exist, and human traffickers are adept at influencing their victims to hide their victimization.

Commanders, other military leaders and all DOD components at all levels are “striving very hard to implement changes to federal laws and DOD-wide policies to push requirements for awareness programs, training for targeted audiences and reporting [cases] to the DOD [inspector general],” he said.

Chin called overseas human trafficking “widespread,” but acknowledged that the number of victims is difficult to quantify. Victims usually are lured from rural areas with promises of working in good-paying jobs, he said.

“A classic sign of human trafficking is indentured servitude, where the victims pay large fees in a very competitive arena to secure jobs,” he said, adding that the high pay they’re promised is just a lure.

The fees to secure jobs become loans, and victims find themselves working as indentured servants to work off what they owe, and they can’t return home because their passports are taken away, Chin said. Victims’ homes often are held as collateral for their employment, he added.

In many instances, victims are misled about where they’re going, he noted.
“One of the classic cases you see is beauticians and barbers [who are] told they’re going to a Gulf nation to work in a salon for a very good salary, and [when] they get off a plane, they’re actually in Afghanistan, working on a forward-operating base under completely different circumstances,” Chin said.

DOD’s efforts to train its personnel to recognize and report human trafficking are paying off, he said.

“Our awareness programs are having a tremendous effect on sensitizing all of our [personnel], and everybody understands what human trafficking is,” he said. “They’re starting to understand it’s not just a sex crime off our bases, especially in Afghanistan. … It’s also a labor crime.”

Announcement Marks Latest Expansion of the Blue Campaign Awareness Efforts
WASHINGTON— The Department of Homeland Security (DHS) today announced a new alliance between the DHS Blue Campaign— the unified voice for DHS’ efforts to combat human trafficking— and Western Union.

Through this alliance, Western Union will provide the Blue Campaign’s multilingual training and awareness materials to select agent locations across the country. Participating agents will also receive additional training from Western Union on how to identify and recognize indicators of human trafficking, as well as how to report suspected cases of human trafficking.

“Today, we are pledging to do more to combat human trafficking by broadening our network of partners which will enable us to better identify and rescue victims of this inexcusable crime, and bring the perpetrators to justice,” said Acting Secretary of Homeland Security Rand Beers. “We’re grateful to have the participation of Western Union in this important effort, which will help save lives, protect innocent victims, and prevent this form of modern day slavery.”

The Blue Campaign works in collaboration with law enforcement, government, non-governmental and private organizations, to protect the basic right of freedom and to bring those who exploit human lives to justice.

Working with DHS, Western Union will use training and awareness materials developed by the DHS Blue Campaign to educate its agents who regularly interact with the public on potential indicators of human trafficking and how to identify potential victims.

In June 2013, the DHS Blue Campaign unveiled new public awareness materials including a Public Service Announcement, posters and handouts to educate on victim identification and crime reporting, the case investigation process, and available resources for victim support. Western Union will display these multilingual materials at Western Union Agent locations throughout the country.
“Ending human trafficking is possible only if everyone steps in and plays a role,” said Barry Koch, chief compliance officer for Western Union. “We are committed to using the trust, reach and power of our brand along with our Agent network to engage the public and arm them with awareness and the resources to spot the signs and report suspect activity.”

In Oct. 2012, DHS announced a partnership with the Department of Transportation and Amtrak to train over 8,000 Amtrak frontline employees and Amtrak police officers to identify and recognize indicators of human trafficking, as well as how to report suspected cases of human trafficking.

FORMER SACRAMENTO WOMAN SENTENCED FOR PART IN HUMAN TRAFFICKING OF TEENAGE GIRLS

Former Sacramento woman sentenced to 9 years for sex trafficking

OAKLAND, Calif. — A former Sacramento woman was sentenced Wednesday to nine years in federal prison on charges stemming from a probe by U.S. Immigration and Customs Enforcement's (ICE) Homeland Security Investigations (HSI) and the FBI that linked her to a scheme to sex traffic teenage girls.

Helen Jean Singh (née Kearney), 22, pleaded guilty earlier this year to participating in a sex trafficking conspiracy involving the prostitution of teenage females. During Wednesday's sentencing, Singh accepted responsibility for her actions.

A federal grand jury indicted Singh and her husband, Mahendar "Mike" Singh, on the sex trafficking conspiracy charge in December 2011. According to the indictment, the pair recruited teenage girls by promising money, drugs and a "family-like environment." The couple maintained control over their victims by providing drugs, using physical force and threats of physical force, and fostering a climate of fear. The Singh's used the Internet to advertise their prostitution enterprise, which spanned from Sacramento County to multiple Bay Area counties.

"Few crimes strike at our community the way sex trafficking does," U.S. Attorney Melinda Haag said. "By sexually exploiting children and young adults for financial gain, sex traffickers have shown that greed has no bounds. My office will continue to lead efforts by law enforcement to fight the menace that is sex trafficking."

The Singhs were arrested in August 2011 after the South San Francisco Police Department responded to a motel near the San Francisco Airport and found Mahendar Singh with three teenage girls. The affidavit alleges the defendants used an Internet website to advertise their victims and employed cell phones and text-messaging to make arrangements with customers.

"While no prison sentence can ever compensate for the physical and emotional toll experienced by trafficking victims, this lengthy prison term should serve as a sobering warning about the consequences facing those who engage in this reprehensible practice," said Clark Settles, special agent in charge ICE Homeland Security Investigations (HSI) San Francisco. "Human traffickers prey on the powerless and the vulnerable. ICE Homeland Security Investigations and its federal law enforcement partners are committed to protecting those who cannot protect themselves."

"The FBI will continue to work with our local, state and federal law enforcement partners to relentlessly pursue and bring to justice sex traffickers who exploit and victimize juveniles," said Acting Special Agent in Charge Michael Gavin of FBI San Francisco. "We will also work with our community partners to help those who are victimized get the assistance they need."

In addition to HSI and the FBI, the other agencies involved in the case included the South San Francisco Police Department; the San Mateo County District Attorney's Office; the Human Trafficking Prosecution Unit of the Criminal Section, Civil Rights Division; U.S. Department of Justice; and the Child Exploitation and Obscenity Section of the Criminal Division, U.S. Department of Justice.

The sentence was handed down by U.S. District Court Judge Phyllis J. Hamilton. Judge Hamilton also sentenced Helen Singh, who was and will remain in custody, to a five-year period of supervised release following her prison term and ordered her to forfeit property and make restitution of $45,000 to one of the victims. Mahendar Singh, who also pleaded guilty previously, received the same sentence April 18.

Assistant U.S. Attorney Andrew S. Huang prosecuted the case with the assistance of legal assistant Vanessa Vargas.

Human trafficking is one of the most heinous crimes that HSI investigates. In its worst manifestation, human trafficking is akin to modern-day slavery. HSI relies on tips from the public to dismantle these organizations. Trafficking victims are often hidden in plain sight, voiceless and scared. Former Chicago Massage Parlor Operator Sentenced to Life in Prison for Human Trafficking of Four Women

Alex Campbell, 45, of Glenview, Ill., a former northwest suburban massage parlor owner was sentenced today to life in federal prison for various crimes including sex-trafficking, forced labor, harboring illegal aliens, confiscating passports to further forced labor and extortion involving four foreign women whom he mentally and physically abused while forcing them to work for him, the Justice Department announced today. The defendant, who operated the Day and Night Spa on Northwest Highway in Mt. Prospect, Ill., used violence and threats of violence to force three women from the Ukraine and one from Belarus to work for him without pay and, at times, little to no subsistence between July 2008 and January 2010.

Campbell, also known as "Dave" and "Daddy" and who called himself "Cowboy," was also ordered to pay approximately $124,000 restitution by U.S. District Judge Robert Gettleman. There is no parole in the federal prison system.

Campbell was convicted at trial in January of this year of three counts each of forced labor, harboring illegal aliens for financial gain and confiscating passports and other immigration documents to force the victims to work and one count each of sex trafficking by force, and extortion. He faced a mandatory minimum sentence of 15 years in prison and a maximum of life on the sex-trafficking count alone, and the judge also imposed maximum prison terms ranging from five to 20 years on each of the remaining counts, to run concurrent with the life sentence.

"Alex Campbell abused women by violently coercing them into labor and commercial sex. By working together with law enforcement and community groups, those women were able to testify about that abuse," said Thomas E. Perez, Assistant Attorney General for the Justice Department’s Civil Rights Division. "Today’s sentence is a victory not only for the Department and the Cook County Human Trafficking Task Force, but also for those women who so bravely came forward and told the truth about their exploitation."

"If you treat human beings as property, to be branded, beaten, raped, and sold, the law will punish you to the greatest extent possible," said Gary S. Shapiro, Acting U.S. Attorney for the Northern District of Illinois. "This sentence ensures Alex Campbell’s incapacitation, which will prevent him from victimizing other women."

"The sentence handed down today sends a clear message to those who think they can callously prey upon vulnerable women to turn a profit," said Gary J. Hartwig, Special Agent-in-Charge of Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations in Chicago. "HSI will continue to work with our law enforcement partners to ensure that those who engage in human trafficking are held accountable for their actions."

Cook County Sheriff Thomas J. Dart, whose sheriff’s police initiated the investigation, said, "I am extremely proud of the effort and resolution of all the agencies involved with the successful investigation, conviction and now sentencing of such a violent individual."

All four victims testified as government witnesses at trial, as well as co-defendant, Danielle John, 25, who pleaded guilty before trial to two counts of harboring illegal aliens for financial gain. She was sentenced previously to three years’ probation. In addition to the trial victims, the government presented evidence that investigators learned of approximately 20 women that Campbell victimized.

The trial showed that Campbell recruited and groomed foreign women without legal status in the United States to become part of his "Family," which he claimed was an international organization that would provide them with support. He offered them jobs in his massage parlor, a place to live, assistance with immigration, and lured each of them to enter into a romantic relationship with him. After gaining their trust, he forced the victims to get tattooed with his moniker, which he said made them his property and allowed him to stop paying them. At the same time, he acquired the women’s passports and visas. The women were forced to work long hours every day and do as Campbell instructed them, and they were beaten and punished if they disobeyed him.

Trial testimony established that Campbell confiscated passports and identity documents from three of the victims, as well as harbored and transported them to ensure their continued labor. Campbell forced one victim to engage in commercial sex acts with customers at various other massage parlors, but not at the Day and Night Spa, which testimony showed he operated "cleanly" to avoid problems with law enforcement. He extorted another victim to pay him more than $25,000 to leave the "Family" by threatening to send a sexually-explicit video recording to her parents in Belarus.

The Cook County State’s Attorney’s Office assisted in the investigation, which was coordinated by the Cook County Human Trafficking Task Force. The task force, together with the Salvation Army Family and Community Services STOP-IT Initiative Against Human Trafficking, operate a toll-free hotline, (877) 606-3158, which victims of trafficking or those with information about human trafficking can call for assistance. The government is represented by Assistant U.S. Attorneys Diane MacArthur and Steven Grimes and Special Litigation Counsel John Richmond of the Civil Rights Division’s Human Trafficking Prosecution Unit.

Deputy Attorney General James Cole met with Jada Pinkett Smith last week to discuss the department’s extensive efforts to end human trafficking. Ms. Pinkett Smith founded the organization,
Don’t Sell Bodies, to raise awareness about this global epidemic and advocate for victims of trafficking. Ms. Pinkett Smith was joined by former trafficking victims who now work to raise awareness and eliminate human trafficking, including Minh Dang and Withelma "T" Ortiz-Macey, Glamour magazine’s 2011 Woman of the Year.

During the meeting the group discussed remarks made by Deputy Cole before the INTERPOL General Assembly in Italy earlier this month, which largely focused on the department’s myriad of efforts to combat trafficking, including the links between transnational organized crime and human trafficking and the department’s prosecution and training efforts in this area.

Human trafficking cases are prosecuted by several Department of Justice components, including the Civil Rights Division and its specialized Human Trafficking Prosecution Unit, the Criminal Division through the Child Exploitation and Obscenity Section, and individual U.S. Attorney’s Offices. These cases are investigated by the Federal Bureau of Investigation, the Department of Homeland Security’s Immigration and Customs Enforcement/Homeland Security Investigations, and partners at the Departments of Labor and State.

In recent years we have demonstrated unprecedented success in fighting both labor and sex trafficking. We are bringing a record number of federal cases, while at the same time, more states than ever before have passed their own anti-trafficking laws. The department has increased the number of human trafficking prosecutions by more than 30 percent in forced labor and adult sex trafficking cases, while also increasing the number of convictions in Innocence Lost National Initiative cases by 30 percent.

Working with federal, state, local, and international law enforcement agencies, we recently secured the longest sentence ever imposed in a forced labor case. In
United States v. Botsvynyuk, the lead defendant was sentenced to life in prison plus twenty years, and his co-conspirator was sentenced to twenty years, for their respective roles in an organized human trafficking scheme that held its victims in forced labor on cleaning crews in and around Philadelphia, Pennsylvania.

Just over a year ago, we initiated a pilot project of multi-agency Anti-Trafficking Coordination Teams (ACTeams) in six judicial districts in the United States. These task forces will prove the value of interagency coordination to address the scourge of human trafficking. In addition to the ACTeams, each U.S. Attorney now participates in some form of anti-trafficking task force.

In addition to our own federal prosecutions, the department’s grant making components are funding state and local law enforcement agencies and victim services organizations to support multidisciplinary, victim-centered task forces dedicated to investigating trafficking crimes and providing culturally-competent assistance to victims.

By taking a multi-disciplinary approach to combating human trafficking and working with our federal, state local and nonprofit partners we can ensure that victims obtain the services that they need and that offenders are prosecuted and sentenced to lengthy jail sentences.

U.S. OFFICIAL ADDRESSES INTERPOL ON HUMAN TRAFFICKING AND TRANSNATIONAL ORGANIZED CRIME

On November 5th, Deputy Attorney General James M. Cole addressed the 81st INTERPOL Ministerial and General Assembly meeting in Rome, Italy. This gathering of INTERPOL member countries marked an important opportunity to recognize joint achievements, build relationships, discuss issues critical to our domestic and global security, and develop a path forward on international law enforcement.

Deputy Attorney General Cole noted the unprecedented level of cooperation between INTERPOL member countries which has led to the development of critical law enforcement tools of 24/7 communication, information sharing and coordinated responses. He also emphasized two important areas that would benefit greatly from INTERPOL’s continued leadership and support and member countries’ investment, vigilance and cooperation: Transnational Organized Crime and Human Trafficking.
"Transnational organized crime poses a significant and growing threat to the security of each of our nations (and citizens) and the international community as a whole. Not only are criminal networks expanding, but they are also diversifying their activities – with dire implications for public safety, public health, democratic institutions and, in this already tough economic climate, the financial stability of nations across the globe. The United Nations estimates that, in 2009, transnational organized criminal activities generated $870 billion in illegal proceeds – equivalent to almost 7 percent of world exports."
To respond to the threat of transnational organized crime, Deputy Attorney General Cole called for a "whole-of-government approach" focused on coordinating resources and expertise:
"We realized that law enforcement measures alone would not fully counter the threat of transnational organized crime. Included in this approach was: the work of our Department of the Treasury to impose financial sanctions on major transnational organized crime groups and individuals; and the work of our Department of State to deny entry to the United States to transnational criminal aliens and others who have been targeted for financial sanctions. As a direct result of these actions, five transnational organized crime groups that span the globe already have been subjected to these crippling financial sanctions."
Deputy Attorney General Cole also stressed the need for "enhanced global attention and a unified law enforcement response" to fight against human trafficking:
"One of the greatest horrors of this crime is that traffickers view their victims as nothing more than a commodity, something that can be bought and sold, or simply taken, and eventually discarded… This crime can take many forms. It is the young woman who moves to another country for the promise of a new life – but instead finds herself enslaved and repeatedly sold for sex. Or the child who ran away from home and finds herself in the same situation because, in desperate need, she accepted help from the wrong person."
Although the specific details may differ, these heinous crimes often have two common elements. First, human trafficking is hidden in plain sight – behind the veil of a prostitution offense, a domestic abuse incident, a physical or sexual assault, a labor dispute, or an immigration crime. Second, victims are often traumatized, and can be weary of – and reluctant to corporate with – law enforcement officials for fear of repercussions from their captors. This is why educating first responders about the factors that may indicate a potential human trafficking offense is a critical step in improving our ability to identify and help trafficking victims.

In front of an international audience, Deputy Attorney General Cole reaffirmed the U.S. commitment to preventing and fighting human trafficking in all of its forms. Last year, the department set a new record in the number of defendants charged in human trafficking cases. Additionally, over the last three years, there has been a 30 percent increase in the number of forced labor and human trafficking cases charged.

The United States has also partnered with law enforcement officials from Mexico and Ukraine, to Germany and Canada to dismantle sex traffic networks and successfully bring perpetrators behinds these crimes to justice. This work – which showcases the value of engaging in global partnerships to combat human trafficking –sends an unmistakable message: we will relentlessly pursue those who trade in the misery of other human beings and we will rescue their victims and bring the perpetrators to justice.

However, these efforts are only the beginning. To successfully combat human trafficking, as Deputy Attorney General said, "prosecution alone is not the answer," which is why we are bringing a renewed focus to preventative measures like:
Prevention through prosecution of trafficking rings before they can ensnare other victims;
prevention through deterrence so that our prosecutions dissuade others who may consider engaging in this crime;
prevention through public awareness; and, lastly,
prevention through the education of potential victims who, driven by fear, poverty, or lack of education, often unwittingly place their lives in the hands of exploitative traffickers.

No single country or law enforcement agency has the power, or the means, to tackle the global criminal enterprises we face. Only by communicating effectively, sharing intelligence and combining resources – within our own governments and with our law enforcement partners around the globe – can we truly understand current and emerging trends and build effective strategies to anticipate, combat and put an end to these crimes.

U.S. STATE DEPARTMENT REVOKED TERRORIST DESIGNATION FOR NEPAL'S COMMUNIST PARTY

The Department of State has revoked the designation of the Communist Party of Nepal (Maoist) (CPN(M)) and its aliases as a Specially Designated Global Terrorist entity under Executive Order 13224, and as a "terrorist organization" from the Terrorist Exclusion List (TEL) under the Immigration and Nationality Act (INA). With these actions, the CPN(M)’s property and interests in property in the United States or within the possession or control of U.S. persons will no longer be blocked, and U.S. entities may engage in transactions with CPN(M) without having to obtain a license.

After a thorough review, the Department has determined that the CPN(M) is no longer engaged in terrorist activity that threatens the security of U.S. nationals or U.S. foreign policy. Additionally, in recent years, the Maoist party has been elected as the head of Nepal’s coalition government, has taken steps to dismantle its apparatus for the conduct of terrorist operations, and has demonstrated a credible commitment to pursuing the peace and reconciliation process in Nepal. Today’s delisting does not seek to overlook or forget the party’s violent past, but rather looks ahead towards the party’s continued engagement in a peaceful, democratic political dialogue in Nepal.

This delisting reflects the United States’ resolve to keep our terrorism sanctions current and demonstrates that a group need not stay on a terrorist list forever should it demonstrate a credible commitment to pursuing peace and reconciliation.

 

ADDITIONAL BACKGROUND: FROM U.S. STATE DEPARTMENT

NEPAL GOVERNMENT AND POLITICAL CONDITIONS

A 10-year Maoist insurgency--punctuated by cease-fires in 2001, 2003, 2005, and 2006--began in 1996. After King Gyanendra announced the reinstatement of Parliament on April 24, 2006, the Maoists declared a 3-month unilateral cease-fire on April 26, 2006 which the new Koirala government reciprocated on May 3, 2006. The Seven-Party Alliance (SPA) and the Maoists signed five agreements, culminating in the comprehensive peace agreement of November 21, 2006, effectively ending the insurgency. However, Maoist violence and intimidation continued in spite of the agreement.

The main agenda of the SPA and the Maoists was to hold a Constituent Assembly election, with the primary responsibility of drafting and promulgating a new constitution defining the future political system in Nepal. The interim constitution, adopted on January 15, 2007, expressed full commitment to democratic ideals and norms, including competitive multi-party democracy, civil liberties, fundamental human rights, adult enfranchisement, periodic elections, press freedom, an independent judiciary, and the rule of law. The interim constitution also guaranteed the basic rights of Nepali citizens to formulate a constitution for themselves and to participate in the Constituent Assembly in an environment free from fear. The interim constitution transferred all powers of the King as head of state to the prime minister and stripped the King of any ceremonial constitutional role. Under the interim constitution, the fate of the monarchy was to be decided by the first meeting of the Constituent Assembly. The interim Parliament was a unicameral house.

After promulgation of the interim constitution, many socially marginalized ethnic communities, including the Madhesis of the lowland Tarai, began widespread protests against the proposed proportional representation system incorporated in the new constitution. Bandhs (general strikes) and protests sometimes turned violent, with clashes between police and demonstrators leading to dozens killed and injured. The government eventually agreed to increase the number of directly elected representatives from the Tarai and implement quotas ensuring representation of women, Madhesis, janajatis, and other groups facing discrimination. Constitutional amendments regarding representation were adopted in March and June 2007. The government signed further agreements with Madhesi and janajati groups agreeing to inclusion in government bodies and institutions as well as commitments to address other issues in August 2007, but those remained to be fully implemented.

Five Maoist ministers were appointed to the Nepali Congress-led cabinet on April 2007. The ministers submitted their resignations on September 18, 2007 over the issue of declaring Nepal a republic and adoption of fully proportional representation system for the Constituent Assembly election. After compromise agreements on these issues were reached--having the interim Parliament declare Nepal a republic but letting the CA implement the measure, and adoption of a mixed electoral system--the constitution was amended again and the Maoist ministers were reinducted on December 31, 2007.

Twice deferred, Nepal's Constituent Assembly election was finally held on April 10, 2008. None of the parties succeeded in getting a simple majority in the CA. The Communist Party of Nepal-Maoist won 218 out of 575 elected seats, followed by the Nepali Congress with 109 seats, the Communist Party of Nepal-United Marxist Leninist with 103 seats, and the Tarai-based Madhesi People's Rights Forum with 50 seats. Six constituencies needed to hold by-elections, five due to one candidate having won two directly elected seats and one due to the newly elected President resigning his seat. The appointed seats were distributed across the parties in the following manner: Maoist 9, NC 5, UML 5, MPRF 2, SP 1, CPN-Marxist Leninist 1, People’s Front Nepal 1, Nepal Workers and Peasants Party 1, and TMDP 1.

The final list of members elected under the proportional representation system was released on May 8, 2008. The members of the Constituent Assembly were sworn in on May 27, 2008, and the first session of the CA was convened on May 28, 2008. In this session, the CA voted to declare Nepal a federal democratic republic by abolishing the monarchy. Out of 564 members of the CA who voted, 560 voted in favor and 4 against the motion.

While the CA has the prime responsibility of drafting a new constitution for Nepal, it also functions as a regular Parliament. Through the fourth amendment to the interim constitution of Nepal on May 28, 2008, the CA also established, for the first time, a largely ceremonial President as the constitutional head of state, as well as a Vice President. The Prime Minister continues to be the head of the government.

Nepal's judiciary is legally separated from the executive and legislative branches and, in practice, has increasingly shown the will to be independent of political influence. However, by asserting executive control over the judiciary, the interim constitution called into question this independence. Under the interim constitution, the Prime Minister appoints the Chief Justice on the recommendation of the Constitutional Council, and the Chief Justice appoints other judges on the recommendation of the Judicial Council. All lower court decisions, including acquittals, are subject to appeal. The Supreme Court is the court of last appeal.

In August 2008, Prime Minister Pushpa Kamal Dahal (Maoist) was sworn in as Prime Minister. Less than a year into his term, Prime Minister Dahal resigned from the government on May 4, 2009 following a dispute over his bid to dismiss the Chief of the Army Staff. On May 23, members from 22 of the 24 political parties represented in the Constituent Assembly elected veteran Communist Party of Nepal-United Marxist Leninist (UML) leader Madhav Kumar Nepal as Prime Minister. Madhav Kumar Nepal was sworn in on May 25, 2009. On June 30, 2010, Prime Minister Nepal announced his resignation "for the sake of consensus" and to end the country's political deadlock following months of Maoist protests. On February 3, 2011, after 16 rounds of voting, Jhala Nath Khanal (UML) was elected Prime Minister; however, 6 months later on August 14, 2011 Khanal resigned from the government, citing the failure to make significant progress on the peace process. On August 29, 2011, Baburam Bhattarai (Maoist) was sworn in as Nepal's 35th Prime Minister, and the fourth Prime Minister since the 2008 CA election.

Human Rights
Since political reform began in 1990, some progress has been achieved in the transition to a more open society with greater respect for human rights; however, substantial problems remain. Poorly trained police sometimes use excessive force in quelling demonstrations. In addition, there have been reports of torture during detention and widespread reports of custodial abuse. In 2000, the government established the National Human Rights Commission (NHRC), a government-appointed commission with a mandate to investigate human rights violations. However, the government continues to stall in implementing the commission's recommendations and has not been able to enforce accountability for recent and past abuses. The King's February 2005 dismissal of the government, subsequent imposition of emergency rule and suspension of many civil rights--including freedom of expression, assembly, and privacy--was a setback for human rights in Nepal. During this 3-month period, censors were deployed to major newspapers, and many political leaders were kept under house arrest. The King's government restricted the media from publishing interviews, articles, or news items against the spirit of the royal proclamation of February 1, 2005 or in support of terrorist or destructive activities. The reinstated government, led by Prime Minister Koirala, reversed these decisions in May 2006. The interim constitution promulgated on January 15, 2007 ensured unrestricted freedom of expression and made the NHRC a constitutional body.

Both the Maoists and security personnel have committed numerous human rights violations. The Maoists used tactics such as kidnapping, torture, bombings, intimidation, killings, and conscription of children. Within the Nepalese security forces, violations ranged from disappearances to executions. After the royal takeover on February 1, 2005 and subsequent imposition of the state of emergency, the security forces arrested many political leaders, student leaders, journalists, and human rights activists under the Public Security Act of 1989, although all were released by June 2005 when the King ended the state of emergency.

After the April 2006 cease-fire announced by the government and the Maoists, incidents of human rights violations by the government declined substantially while incidents of human rights violations by the Maoists continued relatively unabated. Even after signing a comprehensive peace agreement with the government in November 2006, Maoists' extortion, abduction, and intimidation remained largely unchecked. Although activities by other political parties have increased significantly in the rural parts of Nepal, political party representatives, police, non-governmental organization (NGO) workers, and journalists reported continuous threats and intimidation by Maoist-affiliated Young Communist League (YCL), Maoist-affiliated All Nepal National Free Students Union (ANNFSU), UML-affiliated Youth Force (YF), UML-affiliated Youth Action Nepal (YAN), or Nepali Congress-affiliated Tarun Dal cadres. During the January-February 2007 uprising in the Tarai, reports of government security forces using excessive force to quell demonstrations were common.

Major daily English-language newspapers include "The Kathmandu Post," "The Himalayan Times," "Republica," and "The Rising Nepal." The last and its vernacular sister publication are owned by a government corporation. There are hundreds of smaller daily and weekly periodicals that are privately owned and of varying journalistic quality. Views expressed since the 1990 move to democracy are varied and vigorous. There are 394 (334 in use) FM radio and 32 (19 in use) television licenses for privately owned and operated stations, following liberalization of licensing regulations. Radio Nepal and Nepal Television are government-owned and operated. There are over 700 cable television operators nationwide, and satellite dishes to receive television broadcasts abound. Internet penetration in Nepal is approximately 4% of the population. Despite its prominence, the Nepali press is still frequently subject to violence and intimidation by political groups.

Trafficking in women and child labor remain serious problems, but some improvement has been seen; in addition, the founder of a U.S.-backed anti-trafficking organization, Maiti Nepal, won the 2010 CNN Hero award. According to the State Department's 2011 Trafficking in Persons Report, Nepal is mainly a source country for men, women, and children who are subjected to forced labor and sex trafficking. While Nepal is primarily a source country for destinations like India and the Middle East, internal trafficking is also a prominent issue. Lack of prosecution and police complicity in trafficking cases remain major problems. Discrimination against women and lower castes is prevalent.

JUSTICE ARTICLE ABOUT COMBATING HUMAN TRAFFICKING IN THE U.S. AND OTHER COUNTRIES

 Last week Deputy Attorney General James Cole spoke at a symposium on how the Department of Justice is continuing to fight human trafficking, both nationally and abroad. The symposium, titled “A Global Perspective on Human Trafficking,” was held at Yale Law School and sponsored by David B. Fein, the U.S. Attorney for the District of Connecticut, and the FBI. A panel presentation titled “Expanding our Reach: Law Enforcement and NGO Partnerships” was also held during the event. During the panel discussion representatives from law enforcement, victim service groups and non-governmental organizations discussed the critical need to establish support networks for the rescue of and transition services for these vulnerable victims of human trafficking.
At the event, Deputy Attorney General Cole spoke about the scourge of human trafficking and the department’s deep commitment to stopping it:

It seems almost unfathomable that today in the 21st Century, we still live in a world where human trafficking persists.   And yet it exists and is often hiding in plain and painful sight. It’s the young woman who comes to America for the promise of a new life but finds herself enslaved and sold for sex.   Or the child who grew up here in America but ran away from home only to find herself the victim of her desperate acceptance of help from the wrong person.   Or the migrant worker who is deprived of identification, transportation, and access to money in order to ensure his total dependence on his employer. The Department of Justice is resolutely committed to preventing and combating human trafficking in all its forms. For Attorney General Holder and I, this is a deeply held conviction.

Within the Department of Justice, there are an array of components that work to combat human trafficking, including the U.S. Attorney’s Offices, the Civil Rights Division’s Human Trafficking Prosecution Unit, the Criminal Division’s Child Exploitation and Obscenity Section, and the FBI. Additionally, the Office of Justice Programs provides critical funding and grants to states across the country, which help to combat human trafficking nationally and assist victim service organizations in local communities.
Vital partnerships with other federal authorities are also crucial to our efforts to combat human trafficking. These partnerships between federal, state, and local law enforcement agencies, international authorities, and non-governmental organizations have all been critical in combating instances of human trafficking nationally and worldwide.

Such programs and partnerships are proving to be effective. Last year, the Department of Justice charged a record number of defendants in human trafficking cases. Over the last three years, there has been a 30 percent increase in the number of charges. But we are not content to rest on these achievements. We are determined to continue to increase the impact of our efforts.

Last year, the Deputy Attorney General announced the Anti-Trafficking Coordination Team (ACTeam) Initiative, an interagency collaboration among the Department of Justice, Homeland Security, and Labor to further streamline investigations and prosecutions for human trafficking offenses. These ACTeams are now fully operational and are providing enhanced strategic coordination among agencies and federal prosecutors.
We know that pursuing justice within our borders is not enough. That’s why our efforts are also worldwide, echoing the Deputy Attorney General’s commitment today to fighting human trafficking globally. Through our International Criminal Investigation Training Assistance Program (ICITAP), Department officials have helped to train hundreds of prosecutors, investigators and law enforcement officials in seven partner countries spanning three continents.

We also continue to work with the State Department to engage more international partners on human trafficking issues, ensuring that they are also pursuing aggressive enforcement efforts against traffickers and have the tools to do so. Forging these partnerships across borders helps us continue to focus on prevention of trafficking rings while also making sure that victims, who have been irreparably harmed by human trafficking, have the appropriate services and resources at their disposal.
At the Department of Justice, we are committed to continuing to build strategic partnerships across international borders, all with the goal of fighting human trafficking. While we are encouraged by our recent achievements, there is still much work to be done. We will continue to strive for prevention but also justice on behalf of victims of human trafficking.

MODERN HUMAN TRAFFICKING AND THE EMANCIPATION PROCLAMATION

Later this year, we will mark the 150th anniversary of the preliminary Emancipation Proclamation, and as we remember the sad history of slavery in the United States and honor those who fought to end it, we must also recommit ourselves to delivering on the promise of freedom. Because around the world today, 27 million people are living in modern slavery, or what we call trafficking in persons.

That’s why this Administration has made the effort to combat modern slavery a top priority. Here at home, agencies across government are working together to prosecute traffickers, and to bring needed assistance to survivors. Around the world, we are working with governments to improve their response to this crime, and we are supporting anti-trafficking programs in 37 countries with foreign assistance. Our annualTrafficking in Persons Report is the most comprehensive assessment of what governments are doing to stop this crime, and I’m glad you’ve had the chance to hear from Lou de Baca about everything the State Department is doing to move this struggle forward.

Now, when I was a law student in these same classrooms and hallways, I had the opportunity to learn from brilliant scholars and legal minds, and to study cutting-edge ideas about civil rights and children’s issues. So it doesn’t surprise me that that Yale Law School is again leading the way as we develop new innovations and practices to help us fight this horrible crime.

I hope this conference has been an opportunity for all of you to share ideas and build partnerships that will strengthen our efforts to combat modern slavery. Thank you all for your tireless work to stop this crime.

Thank you, David [Fein], for that introduction.   Thank you Yale Law School, the Trade of Innocents team, the United States Attorney’s Office and the Federal Bureau of Investigation for organizing this important symposium.

I am honored to join with so many esteemed colleagues gathered here to talk about what more we can all do in the global fight against human trafficking.   The groups represented in this room have all been critical partners in trying to eradicate this scourge at home and abroad.

At the Department of Justice we have a number of components deeply involved in our effort to combat human trafficking.   These include the United States Attorney’s Offices, the Civil Rights Division’s Human Trafficking Prosecution Unit, the Criminal Division’s Child Exploitation and Obscenity Section, and the FBI.   And the Office of Justice Programs funds task forces across the country. But even with all of those Department participants, we cannot win this fight alone.

That is why I would like to take this opportunity to talk about the vital importance of partnerships in the Department’s effort to combat human trafficking. Law enforcement agencies; federal, state, local, and international authorities; and non-governmental organizations such as the Polaris Project and the International Justice Mission all have key roles to play in advancing this critical mission.

It seems almost unfathomable that today in the 21st Century, we still live in a world where human trafficking persists.

And yet it exists and is often hiding in plain and painful sight. It’s the young woman who comes to America for the promise of a new life but finds herself enslaved and sold for sex.   Or the child who grew up here in America but ran away from home only to find herself the victim of her desperate acceptance of help from the wrong person.   Or the migrant worker who is deprived of identification, transportation, and access to money in order to ensure his total dependence on his employer.

The Department of Justice is resolutely committed to preventing and combating human trafficking in all its forms. For Attorney General Holder and I, this is a deeply held conviction. Earlier this month, I had the privilege of speaking about this modern day form of slavery at the National Underground Railroad Freedom Center.   Later this month, the Attorney General will be delivering an important speech on human trafficking at the Clinton Presidential Library.

Yet the Department’s commitment extends beyond mere words by its leadership and transcend into real action on the ground – action that has saved lives, delivered on the promise of freedom, and restored dignity to women, children and men held in bondage.

Last year, the Department set a new record in the number of defendants charged in human trafficking cases in a single year.   And over the last three years, there has been a 30-percent increase in the number of forced labor and adult sex trafficking cases charged.

Here in Connecticut, you have served as leaders in fighting human trafficking.   In 2008, Dennis Paris was sentenced to 30 years in prison, and ten other co-defendants were convicted in connection with a Hartford-based sex trafficking ring that targeted young, vulnerable women and girls.   And just last year, Jarell Sanderson was sentenced right here in New Haven to over 25 years in prison for the sex trafficking of a 14-year-old victim.

Now, there’s always a bit of a good news/bad news aspect to higher numbers of prosecutions because they reflect not only the good—an effective enforcement effort--but also the bad—the reality that these cases are there to be prosecuted.  

Yet it also reminds us that an absolutely essential element in bringing these prosecutions in the first instance has been a broad array of partnerships. These partnerships have proven to be force multipliers and yielded concrete results.  

Take the tragic and shocking case out of Virginia where an MS-13 gang member preyed on a 12-year-old girl.   He forced her into prostitution, seven days a week, using illegal drugs to keep her compliant.   The defendant and his fellow gang members aggressively marketed her for prostitution at apartments, hotels, and businesses.

Law enforcement agencies in partnership with victim advocates working through the Northern Virginia Human Trafficking Task Force, we're able to discover this crime, stop it, and last October—two years from the very day that the victim was first ensnared—her trafficker was sentenced to life in prison.

The Department also partners with federal authorities to combat human trafficking.

Last February, the Justice Department launched a Human Trafficking Enhanced Enforcement Initiative to take our counter-trafficking enforcement efforts to a new level.

As a part of this effort, Attorney General Holder, along with the Secretary of Homeland Security Janet Napolitano and the Secretary of Labor Hilda Solis, announced the Anti-Trafficking Coordination Team – or “ACTeam” – Initiative. This Initiative is an interagency collaboration among the Departments of Justice, Homeland Security, and Labor aimed at streamlining federal criminal investigations and prosecutions of human trafficking offenses.

Following a rigorous interagency selection process, we launched six Pilot ACTeams around the country.   Today, these teams are fully operational and are developing high-impact human trafficking investigations and prosecutions.

As we continue to increase coordination at the federal level, we are also partnering with state and local law enforcement authorities and the National Association of Attorneys General on its Human Trafficking Initiative.

We are providing grant funding through an Enhanced Collaborative Model to state and local law enforcement partners – and to victim service organizations – pairing proactive law enforcement efforts to stop traffickers, with programs to help victims heal and rebuild their lives.

Also we are hosting regional training forums, delivering training and technical assistance to the broader anti-trafficking community, and developing training curricula for state prosecutors and judges.

Yet even as we leverage these domestic partnerships, we recognize, as the title of this symposium notes, that a global perspective on trafficking is needed. Pursuing justice within our borders is simply not enough.   That is why we are also taking steps to forge partnerships across borders.

One concrete example of this can be seen in Southeast Asia. During my visit to the Philippines last November, I had the honor of addressing the graduates of a course on Human Trafficking at the Philippine National Police Headquarters. The course was conducted by American and Philippine police instructors through DOJ’s International Criminal Investigative Training Assistance Program (ICITAP). Graduates of this course are now key partners on the front lines of the fight against human trafficking.

Closer to home, we are working with Mexican law enforcement authorities to dismantle sex trafficking networks operating on both sides of the   border. Our joint actions have brought freedom to victims, and secured landmark convictions and substantial sentences against the traffickers in a number of high-impact bilateral cases.

And we continue to work with our friends at the State Department to engage a wider number of international partners on this issue, and to ensure that they, too, are pursuing aggressive enforcement efforts against traffickers and have the tools to do so.   I am glad to see Ambassador CdeBaca will be speaking later in the afternoon to share the State Department’s perspective.

And so, in surveying these partnerships, while we can all be encouraged by our recent achievements in the fight against human trafficking, we have far more to do.


We must proceed with the humility of knowing that lives have been irreparably harmed and that justice alone can only bring a quantum of solace. It simply cannot undo the harm.

That is why, above and beyond all else, our various partnerships must focus on prevention. Prevention through prosecution of trafficking rings before they can ensnare other victims. Prevention through deterrence so that our prosecutions dissuade others who may follow suit.  Prevention through public awareness as films like Trade of Innocents importantly seek to generate. And, lastly, prevention through the education of potential victims who driven by fear, poverty, or lack of education often unwittingly place their lives in the hands of exploitative traffickers.

The efforts we all make in this area are of critical importance.   They are of critical importance to the victims, to their families and friends, and, frankly, to the fabric of our entire nation.    These are truly among the most vulnerable members of our communities and are in desperate need of our help.

I want to thank all of you for the efforts you have made and that you will continue to make to fight for justice on behalf of victims of human trafficking.   Without you they have little hope.
